11 <br /> Attachment 2 <br /> Solid Waste <br /> The applicant has indicated development within the project will conform to the Orange County Solidp7w <br /> Waste Management Ordinance as required by Orange County UDO Section 5.8.4(A)(3)(h) (Attachment <br /> 5). <br /> Proposed Conditions <br /> Per NCGS 160D-701, imposed conditions and site-specific standards are limited to those that address <br /> conformance of the development and use of the site to local government ordinances and adopted plans <br /> or the impacts reasonably expected to be generated by the development or use of the site. However, <br /> pursuant to NCGS 160D-701, "...as a basis for denying a zoning or rezoning request from a school, the <br /> level of service of a road facility or facilities abutting the school or proximately located to the school [may <br /> not be considered]. Per Section 2.9.1 (F) (3) of the UDO, mutually agreed upon conditions can be <br /> imposed as part this process only if they address: <br /> 1. The compatibility of the proposed development with surrounding property, and/or <br /> 2. Proposed support facilities (i.e. roadways and access points, parking, pedestrian and vehicular <br /> circulation systems, screening and buffer areas, etc.) <br /> The following voluntary conditions are being offered by the applicant, based on both staff and Planning <br /> Board comments: <br /> 1. Application: Project shall be completed as presented in approved site plan/application packet. <br /> Applications to rezone property to the MPD-CD Conditional District shall be processed in <br /> accordance with the procedures in UDO Section 2.9 and 6.7; <br /> 2. To construct left turn lanes with 150' of full storage at both site driveways (US 70A and Lawrence <br /> Road); <br /> 3. To construct southbound and northbound left-turn lanes on Lawrence Road at the intersection <br /> of Lawrence Road and US 70. This offer to construct would be accompanied by the posting of a <br /> performance bond with NCDOT to guarantee the construction of the aforementioned turn lanes. <br /> Should such construction not be acceptable due to lack of available right-of-way or disapproval <br /> by any necessary regulatory authority, the applicant offers to instead pay $400,000 to Orange <br /> County. Either one of these commitments is offered to be realized prior to issuance of the <br /> Certificate of Occupancy for the charter school. Further details are available in Attachment 1; <br /> 4. Installation of a Type C buffer along Lawrence Road prior to issuance of a certificate of <br /> compliance for the school <br /> 5. Lighting for the tennis courts shall be the minimum necessary to meet UDO requirements; <br /> 6. The property owner shall conduct a Traffic Impact Analysis (TIA)five (5) years after the opening <br /> of the school and submit the TIA to Orange County Planning and Inspections Department; <br /> 7. All handicapped parking spaces shall be installed with striped hashmarks to provide additional <br /> separation between vehicles; <br /> 8. Subject to approval by the NCDOT, the property owner shall install a concrete median along <br /> with additional striping on Lawrence Road at the intersection with Old NC 10 Highway prior to <br /> issuance of a certificate of compliance for the school; <br /> 9. Subject to approval by the North Carolina Department of Transportation, the property owner <br /> shall install school zone/35 m.p.h. speed limit signage on Lawrence Road and US 70A in the <br /> vicinity of the school; <br /> 11 <br />
