173 <br /> r <br /> North Carolina Wildlife Resources Commission f <br /> Cameron Ingram, Executive Director <br /> MEMORANDUM <br /> TO: Lyn Hardison,Environmental Assistance and SEPA Coordinator <br /> NCDENR Division of Environmental Assistance and Customer Services <br /> FROM: Olivia Munzer,Western Piedmont Coordinator <br /> Habitat Conservation <br /> DATE: 08 March 2023 <br /> SUBJECT: Request for Review of Eden View Subdivision Environmental Assessment in Bingham, <br /> Orange County,North Carolina. DEQ Project No. 23-0163. <br /> Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the <br /> proposed project description. Comments are provided in accordance with certain provisions of the United <br /> States (U.S.) National Environmental Policy Act, Fish and Wildlife Coordination Act (48 Stat. 401, as <br /> amended; 16 U.S.C. 661 et seq.), and North Carolina General Statutes (G.S. 113-131 et seq.). <br /> CJT PA is proposing to construct the Eden View Subdivision located at 4901 Dairyland Road in <br /> Bingham,Orange County,North Carolina. The 190.61-acre site will consist of 38 single-family homes, a <br /> pavilion with parking, greenhouse, and a working farm with associated structures. According to the <br /> documents, approximately 76 acres will be Open Space and it will include the farm pond,riparian buffers <br /> around Watery Fork Creek,Hudson Branch, an unnamed tributary in the northeast corner of the property, <br /> and most of the wetlands. <br /> Hudson Branch and Watery Fork Creek and their unnamed tributaries occur on the site. Wetlands and a <br /> farm pond are also located on the site. Watery Fork Creek and Hudson Branch are classified by NC <br /> Division of Water Resources as Water Supply II streams,High Quality Waters, and Nutrient Sensitive <br /> Waters, and Watery Fork Creek is also a Critical Area. The site is in the Cane Creek Watershed within the <br /> Cape Fear River Basin. <br /> We have records of the state endangered Carolina creekshell(Villosa vaughaniana), state threatened <br /> creeper(Strophitus undulatus), and Carolina darter(Etheostoma collis)within the Cane Creek Watershed. <br /> The U.S. Fish and Wildlife Service lists the proposed endangered tricolored bat(Perimyotis subflavus) <br /> and candidate monarch butterfly(Danus plexippus)as having the potential to occur within the site if <br /> habitat is present. Although we do not have records for state or federally-listed rare,threatened, or <br /> endangered species at the site. The lack of records from the site does not imply or confirm the absence of <br /> federal or state-listed species.
