13 <br /> Attachment 2 <br /> Proposed Conditions <br /> Per NCGS 160D-703, imposed conditions and site-specific standards are limited to those that address <br /> conformance of the development and use of the site to local government ordinances and adopted plans <br /> or the impacts reasonably expected to be generated by the development or use of the site. Per Section <br /> 2.9.1 (F) (3) of the UDO, mutually agreed upon conditions can be imposed as part this process only if <br /> they address: <br /> 1. The compatibility of the proposed development with surrounding property, <br /> 2. Proposed support facilities (i.e. roadways and access points, parking, pedestrian and vehicular <br /> circulation systems, screening and buffer areas, etc.) and/or <br /> 3. All other matters the County may find appropriate or the petitioner may propose. <br /> The following voluntary conditions are being offered by the applicant: <br /> 1. Application: Project shall be completed as presented in approved site plan/application packet, <br /> including all open space and recreation dedications and offered construction and grading <br /> requirements. Applications to rezone property to a Conditional District shall be processed in <br /> accordance with the procedures in UDO Section 2.9; <br /> 2. The uses on the farm and associated permanent conservation areas will be limited to only those <br /> uses that are currently allowed on existing farms in the Orange Grove Community as of the date <br /> of approval; <br /> 3. Additional plantings will be added to the western property line of lot#34 to screen the view from <br /> parcel 9841322556; <br /> 4. The site property line will be marked with signage that reads "DANGER, NO TRESPASSING — <br /> FARM EQUIPMENT IN USE" at lots 7 through 11 with signage facing both directions; <br /> 5. The developer will install a fence with no trespassing signage along the shared property line with <br /> tax parcel 9841734586; <br /> 6. The developer will notify prospective new residents of the Eden View Acres subdivision of the <br /> presence of a shooting range on the adjacent property, so long as that use continues; <br /> 7. The Developer will notify prospective new property purchasers that this is a voluntary agriculture <br /> district. <br /> Of the above conditions, conditions 2-7 were added subsequent to Planning Board review. The specific <br /> changes recommended by the Planning Board are noted as conditions 5 and 6 above. Separate from <br /> Planning Board recommendation, the applicant has also offered an additional four conditions, noted as <br /> conditions 2, 3, 4, and 7 above, in response to public comment received at the Planning Board meeting. <br /> All four additional conditions have been incorporated into the Ordinance in Attachment 8. <br /> 10 <br />
