74 <br /> Section 12. <br /> "Common Area" or "Common Areas" shall mean and refer to the Street Lights, the Roadways, <br /> including any sidewalks, drainage facilities and other improvements located therein(prior to their <br /> acceptance for maintenance by the North Carolina Department of Transportation or other <br /> governmental entity), all pedestrian trails, walking paths and amenity areas intended for the <br /> common use and enjoyment of all Owners, and any other property specifically shown and <br /> designated on any Plat as "Community Open Space," "Cemetery," "Common Area," "Common <br /> Open Area," "Common Open Space," "Open Space," "COS," or other similar designation. The <br /> Common Areas shall be initially owned by the Declarant, and ultimately owned by the <br /> Association, except as otherwise provided herein, for the common use, benefit and enjoyment of <br /> the Owners. The Declarant reserves the right, but not the obligation, to provide additional <br /> Common Areas within the Project. <br /> Section 13. <br /> Section 14. <br /> "Declarant" shall mean and refer to Dairyland Farm, LLC, a North Carolina limited liability <br /> company, its successors in title and assigns, provided that any such successor-in-title or assign <br /> shall acquire for the purpose of development and/or sale all or substantially all of the remaining <br /> undeveloped or unsold portions of the Property and, provided further, that in the instrument of <br /> conveyance to any such successor-in-title or assign, such successor-in-title or assign is designated <br /> as the "Declarant" hereunder by the grantor of such conveyance, which grantor shall be the <br /> "Declarant"hereunder at the time of such conveyance. <br /> "Declarant Control Period" shall mean and refer to the period of time during which the Declarant <br /> may appoint or remove the members of the Board of Directors of the Association. The Declarant <br /> Control Period shall terminate on the Turnover Date. <br /> Section 15. <br /> "Declaration" shall mean and refer to this Declaration of Covenants, Conditions and Restrictions <br /> as same may be amended and/or supplemented from time to time as herein provided. <br /> Section 16. <br /> "Dwelling Unit" shall mean and refer to a residential dwelling located upon a Lot. <br /> Section 17. <br /> Section 18. <br /> "Guidelines" shall mean and refer to the Architectural, Design and Landscape Guidelines. <br /> Section 19. <br /> 3 <br />
