108 <br /> (3) Easements for the installation, maintenance, repair and removal of sidewalks, if any, over, <br /> across and under those portions of the Property shown and designated as "Sidewalk Easements" <br /> or other similar designation on the Plat(herein referred to as the "Sidewalk Easements"). <br /> (4) Easements for the installation,maintenance,repair and removal of storm drainage facilities <br /> within the areas shown as "Stormwater BMP Easement," "S.D.E.... "Storm Drainage Easement," <br /> or other similar designation on the Plats. <br /> (5) Easements for the installation, maintenance, repair and removal of pedestrian trails and <br /> walking paths within areas designated as such on the Plats. <br /> All of the above-described areas and items shall herein be referred to as the "Maintenance Areas." <br /> The Association shall maintain the Maintenance Areas to a consistent standard of maintenance <br /> typical of a first-class development. Notwithstanding the foregoing, the Association shall not be <br /> obligated to maintain the Maintenance Areas that are located on the Lots. The Association shall <br /> have the right, but not the obligation, to enter onto and maintain the Maintenance Areas that are <br /> located on the Lots. Each Owner shall be obligated to maintain all portions of any Maintenance <br /> Area located upon his or her Lot to the extent the Association does not maintain it. <br /> Section 7. Utility and Drainage Easements <br /> . The Property shall be subject to all easements and rights-of-way for utilities and drainage shown <br /> on the Plats, including, but not limited to, those certain easements shown and designated on the <br /> Plats as: <br /> (a) "Utility Easement'; and <br /> (b) "Stormwater BMP Easement' or "Public Storm Drainage Easement' or "Drainage <br /> Easement' or"S.D.E." <br /> Such easements are hereby established for the use of Declarant, its successors and assigns, and are <br /> hereby established for the use of the Association, its successors and assigns, and include, without <br /> limitation, storm drainage easements of variable width,whether or not depicted on a Plat, over the <br /> entire area within all ditches along any Roadway. <br /> Additionally, Declarant hereby reserves, for the benefit of itself, its successors and assigns, and <br /> grants to the Declarant and the Association, its successors and assigns, a non-exclusive easement <br /> and right-of-way over,under and along the Maintenance Areas for the installation and maintenance <br /> of lines, conduits, pipes and other equipment necessary for furnishing electric power, gas, <br /> telephone service, cable service, water, irrigation, septic system, sanitary sewer and drainage <br /> facilities,storm drainage and/or other utilities. Within the above-described easements no structure, <br /> planting or other material shall be placed or permitted to remain which may damage or interfere <br /> with the installation of utilities or which may change the direction or flow of drainage channels in <br /> the easements. This establishment of easements shall not prohibit the construction of driveways, <br /> at locations approved by the Architectural Review Board, over such easements. <br /> Section 8.
