97 <br /> "Improvement"shall have the same meaning as set forth in Article VIII hereof. <br /> Section 20. <br /> "Lot"shall mean and refer to any numbered or lettered tract of land(excluding any Common Area) <br /> shown on any Plat which is a part of the Property and which shall be restricted for such uses as are <br /> consistent with this Declaration and any other restrictions covering the area wherein the tract of <br /> land is located. No tract of land shall become a"Lot"as that word is used herein until a Plat of <br /> the area in which the same is located is recorded in the Office of the Register of Deeds of Chatham <br /> County,North Carolina. <br /> Section 21. <br /> "Maintenance Areas"shall have the meaning as set forth in Article X hereof. <br /> Section 22. <br /> "Member" shall mean and refer to every person or entity who holds membership in the <br /> Association. <br /> Section 23. <br /> "Mortgage"shall mean any mortgage or deed of trust constituting a first lien on a Lot. <br /> Section 24. <br /> "Mortgagee"shall mean the owner and holder of a Mortgage at the time such term is being applied. <br /> Upon request,each Owner shall be obligated to furnish to the Association the name and address <br /> of the holder of any Mortgage encumbering such Owner's Lot. <br /> Section 25. <br /> "Occupant"shall mean and refer to any person occupying all or any portion of a Lot or the Property <br /> for any period of time,regardless of whether such person is a tenant of the Owner of such Lot or <br /> portion of the Property. <br /> Section 26. <br /> "Owner"shall mean and refer to the record owner,whether one or more persons or entities,of fee <br /> simple title to any Lot or other portion of the Property(excluding any Common Area),and shall <br /> include Declarant as to any Lot or other portion of the Property owned by Declarant unless <br /> otherwise qualified herein, but excluding those having such interest merely as security for the <br /> performance of an obligation. <br /> Section 27. <br /> Section 28. <br /> 4 <br />
