Proposed Access and Transportation Network Improvements The Project is proposing access from Lawrence Road and US 70 Business. The following access improvements, as recommended in the submitted Transportation Impact Analysis (TIA), have been proposed: o US 70 Alt. at Lawrence Road • Install a traffic signal • Construct an exclusive northbound left-turn lane with a minimum of 200 feet of storage plus taper • Construct an exclusive southbound right-turn lane with a minimum of 100 feet of storage plus taper • Construct an exclusive southbound left-turn lane with a minimum of 50 feet of storage plus taper o US 70 at Lawrence Road: • Construct an exclusive northbound left-turn lane with a minimum of 100 feet of storage plus taper • Construct an exclusive southbound left-turn lane with a minimum of 200 feet of storage plus taper • Adjust signal phasing and timing o Lawrence Road at Site Driveway 1: • Construct the full movement Site Driveway 1 with one ingress and two egress lanes • Construct an exclusive southbound left-turn lane with a minimum of 150 feet of storage plus taper o US 70 Alt. at Site Driveway 2: • Construct the full movement Site Driveway 2 with one ingress and two egress lanes • Construct an exclusive eastbound right-turn lane with a minimum of 75 feet of storage plus taper • Construct an exclusive westbound left-turn lane with a minimum of 150 feet of storage plus taper The transportation improvements proposed by the TIA are subject to the NC Department of Transportation (NCDOT) Municipal School Transportation Assistance ("MSTA") legislation NCGS 136-18 (29a), which specifies school traffic generation calculations and parameters for reviewing impacts to the local transportation network ("highway system"). It also requires the NCDOT to reimburse the school for any transportation improvements to the highway system. In advance of the Planning Board meeting, the applicant has made the proffer to construct road improvements, the full details of which can be found in Attachment 1. In summary, the proffer includes commitments to construct southbound and northbound left-turn lanes on Lawrence Road at the intersection of Lawrence Road and US 70. This offer to construct would be accompanied by the posting of a performance bond with NCDOT, of which Orange County would be included as a rider, to guarantee the construction of the aforementioned turn lanes. Should such construction not be acceptable due to lack of available right-of-way or disapproval by any necessary regulatory authority, the applicant offers to instead pay $400,000 to Orange County. Either one of these commitments is offered to be realized prior to issuance of the Certificate of Occupancy for the charter school.
