271 <br /> took place in the dormant season, well after first frost, the habitats capable of <br /> supporting this species contained a "weedy" associate floristic composition not <br /> typically associated with the presence of Michaux's sumac. Additionally, no <br /> bare/naked Michaux's sumac stems were identified in this effort. It is the <br /> surveyor's opinion that Michaux's sumac is not present within the PSA. If for some <br /> reason surveys are requested during the appropriate survey window, Three Oaks <br /> can complete those at that time and update the survey results. A review of the Fall <br /> 2022 NCNHP dataset indicates no known Michaux's sumac EO's within the PSA, <br /> or within 1.0 mile of the PSA. <br /> 4.2 NCNHP State-Listed Species <br /> The NCNHP tracks state listed species that are not currently protected by the USFWS <br /> under the Federal ESA but are tracked by the State due to their rarity in North Carolina. <br /> These species are compiled in the NCNHP 2020 Rare Animal and Plant Lists. <br /> The NCNHP Rare Plant List includes North Carolina legal status information from the <br /> North Carolina Plant Conservation Program (NCPCP), a unit of the Department of <br /> Agriculture and Consumer Services and the agency responsible for the listing and <br /> protection of North Carolina's endangered and threatened plants, under provisions of the <br /> North Carolina Plant Protection and Conservation Act (North Carolina General Statutes - <br /> Chapter 106, Article 1913). The NCNHP Rare Animal List contains species listed by the <br /> NCWRC. NCWRC is responsible for the listing and protection of the state's nongame <br /> species of mammals, birds, reptiles, amphibians, freshwater fishes, mollusks, and <br /> crustaceans,under North Carolina General Statutes - Chapter 113, Article 25. <br /> On the State level, statuses that apply to species listed for Orange County include the <br /> following: <br /> • Endangered - Any native or once-native species of wild animal whose continued <br /> existence as a viable component of the state's fauna is determined to be in <br /> jeopardy or any species of wild animal determined to be an Endangered species <br /> pursuant to the Federal ESA(General Statute 113-25). <br /> • Threatened - Any native or once-native species of wild animal which is likely to <br /> become an endangered species within the foreseeable future throughout all or a <br /> significant portion of its range, or one that is designated as a Threatened species <br /> pursuant to the Federal ESA(General Statute 113-25). <br /> • Special Concern - Any species of wild animal native or once-native to North <br /> Carolina which is determined by the NCWRC to require monitoring, but which <br /> may be taken under regulations adopted under the provisions of the Article <br /> (General Statute 113-25). <br /> • Special Concern — Vulnerable - Any species or higher taxon of plant which is <br /> likely to become a threatened species within the foreseeable future (North <br /> Carolina Administrative Code 02 NCAC 48F .0401). <br />
