3 <br /> Public Notification: In accordance with Section 2.8.7 of the LIDO, notices of the Public Hearing <br /> were mailed via first class mail to property owners within 1,000 feet of the subject parcel. These <br /> notices were mailed on February 21, 2023, 14 days before the meeting. Staff also posted the <br /> subject parcel with a signs on February 21, 2023, 14 days before the meeting. See Attachment <br /> 3 for the notification materials. <br /> Planning Board Recommendation: The Planning Board reviewed the zoning atlas amendment <br /> at its March 8, 2023 regular meeting. At this meeting the Board voted 9 to 3 to recommend <br /> denial of the application based on its finding that the application is inconsistent with the <br /> Comprehensive Plan. <br /> Excerpts of the minutes from the meeting are included in Attachment 6. Agenda materials from <br /> the meeting can be viewed at: https://www.co.orange.nc.us/AgendaCenter/Planning-Board-26 <br /> Planning Director's Recommendation: The Planning Director recommends approval of the: <br /> 1. Statement of Consistency indicating the zoning atlas amendment(s) are reasonable <br /> and in the public interest as contained in Attachment 7. <br /> 2. Ordinance amending the Zoning Atlas, as well as imposing development conditions, <br /> for the identified parcel as contained in Attachment 8. <br /> FINANCIAL IMPACT: This request has been reviewed by various County departments who <br /> have determined that the approval of the request would not create the need for additional <br /> funding for the provision of County services. Costs associated with advertising, including the <br /> public hearing notice and mailings, are covered by the application fee. <br /> SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to <br /> this item: <br /> • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND <br /> ENVIRONMENTAL POLICIES <br /> The fair treatment and meaningful involvement of people of all races, cultures, incomes <br /> and educational levels with respect to the development and enforcement of <br /> environmental laws, regulations, policies, and decisions. Fair treatment means that no <br /> group of people should bear a disproportionate share of the negative environmental <br /> consequences resulting from industrial, governmental and commercial operations or <br /> policies. <br /> ENVIRONMENTAL IMPACT: There is no Orange County Environmental Responsibility Goal <br /> impact associated with this item. <br /> RECOMMENDATION(S): The Manager recommends the Board: <br /> 1. Conduct the public hearing and receive the Planning Board and staff recommendations <br /> and public comments; <br /> 2. Close the public hearing; and <br /> 3. Vote to Approve the Statement of Consistency (Attachment 7) and Zoning Atlas <br /> Amendments (Attachment 8). <br /> OR <br /> Vote to Deny the Zoning Atlas Amendments along with either the Statement of <br /> Consistency (Attachment 7) or a stated rationale of inconsistency with the County's <br /> adopted plans. <br />
