Water and wastewater services will be <br /> provided via a private well and septic system that meet Orange County Environmental Health standards. <br /> Erosion Control/Stormwater Regulations <br /> The applicant has indicated the project will conform to existing stormwater management (Section 6.14) and <br /> erosion and sedimentation control (Section 6.15) regulations of the LIDO. See attached memo (Subject: <br /> Summary of Findings Regarding Conformance with Orange County Unified Development Ordinance <br /> (UDO) for Erosion and Sedimentation Control and Stormwater Management). <br /> Land Use Buffers/Setbacks <br /> North 75' Type F Buffer/ 50' Setback <br /> South 100' Type F Buffer/ 20' Setback <br /> East 30' Type B Buffer/ 50' Setback <br /> West 100' Type F Buffer/20' Setback <br /> Environmental Assessment (EA) <br /> The applicant has provided an Environmental Assessment (EA) application and supporting materials as <br /> required in Section 6.16 of the UDO with their submittal. These materials will be shared with various <br /> State agencies via the NC Department of Administration's State Clearinghouse. Planning and DEAPR <br /> Staff have jointly reviewed the materials and agree with a determination of "Finding of No Significant <br /> Impact (FONSI)" as required in Section 2.25.1 (B) (5) of the UDO. This determination eliminates a <br /> requirement from the applicant to provide a more detailed Environmental Impact Statement (EIS) process <br /> as outlined in Sections 2.25.2 and 6.16.4 of the UDO. <br /> Solid Waste <br /> The applicant has indicated development within the project will conform to the Orange County Solid <br /> Waste Management Ordinance, <br /> Proposed Conditions <br /> Per NCGS 160D-703, imposed conditions and site-specific standards are limited to those that address <br /> conformance of the development and use of the site to local government ordinances and adopted plans <br /> or the impacts reasonably expected to be generated by the development or use of the site. Per Section <br /> 2.9.1 (F) (3) of the UDO, mutually agreed upon conditions can be imposed as part this process only if <br /> they address: <br /> 1. The compatibility of the proposed development with surrounding property, <br /> 2. Proposed support facilities (i.e. roadways and access points, parking, pedestrian and vehicular <br /> circulation systems, screening and buffer areas, etc.) and/or <br /> 3. All other matters the County may find appropriate or the petitioner may propose. <br /> 7 <br />
