<br /> <br />Hazard Mitigation Page 45 FEMA-DR-4393-0042 Orange County <br />Grant Agreement <br />D-22 <br /> <br />(q) It will comply with 523 and 527 of the Public Health Service Act of 1912 “(42 <br />U.S.C. 290 dd-3 and 290 ee-3)”, as amended, relating to confidentiality of alcohol <br />and drug abuse patient records; <br /> <br />(r) It will comply with Chapter 63 of Title 42, Lead-Based Paint Poisoning Prevention <br />“(42 U.S.C. 4821 et seq.)” which prohibits the use of lead based paint in <br />construction of rehabilitation or residential structures; <br /> <br />(s) It will comply with the Energy Policy and Conservation Act, 42 U.S.C. §6291 et. <br />seq. <br /> <br /> <br />(t) In the performance of this Agreement, the RECIPIENT/SUBGRANTEE shall <br />make maximum use of products containing recovered materials that are EPA- <br />designated items unless the product cannot be acquired— <br /> <br />Competitively within a timeframe providing for compliance with the <br />contract performance schedule; <br /> <br />Meeting contract performance requirements; or <br /> <br />At a reasonable price. <br /> <br />Information about this requirement, along with the list of EPA-designated items, is <br />available at EPA’s Comprehensive Procurement Guidelines webpage: <br />https://www.epa.gov/smm/comprehensive- procurement-guideline-cpg-program. <br /> <br />The Contractor also agrees to comply with all other applicable requirements of <br />Section 6002 of the Solid Waste Disposal Act. <br /> <br />See also 2 CFR 200.322. <br /> <br />(u) Prohibition on Contracting for Covered Telecommunications Equipment or <br />Services <br /> <br />(a) Definitions.
