<br /> <br />Hazard Mitigation Page 43 FEMA-DR-4393-0042 Orange County <br />Grant Agreement <br />D-20 <br /> <br />on the basis of age or with respect to otherwise qualified handicapped <br />individuals as provided in Section 504 of the Rehabilitation Act of 1973 <br />(codified as amended at 29 U.S.C. 794 (prohibiting discrimination on the <br />basis of handicap); Executive Order 11063 as amended by Executive Order <br />2259; and Section 109 of the Housing and Community Development Act of <br />1974, as amended; <br /> <br /> (4) Executive Order 11246 as amended by Executive Orders 11375 and 12086, <br />and the regulations issued pursuant thereto, which provide that no person <br />shall be discriminated against on the basis of race, color, religion, sex or <br />national origin in all phases of employment during the performance of <br />federal or federally assisted construction contracts; affirmative action to <br />insure fair treatment in employment, upgrading, demotion, or transfer; <br />recruitment advertising; layoff or termination, rates of pay or other forms <br />of compensation; and election for training and apprenticeship. <br /> <br /> <br />(g) The RECIPIENT/SUBGRANTEE agrees to comply with Titles I, II, III, IV and V <br />of the Americans With Disabilities Act of 1990 (prohibiting discrimination on the <br />basis of disability). <br /> <br />(h) The Copeland “Anti-Kickback” Act. Contractor. RECIPIENT/SUBGRANTEE <br />shall comply with 18 U.S.C. § 874, 40 U.S.C. § 3145, and the requirements of 29 <br />C.F.R. Part 3 as may be applicable, which are incorporated by reference into this <br />Agreement. <br /> <br />Subcontracts. The RECIPIENT/SUBGRANTEE or subcontractor shall insert in <br />any subcontracts the clause above and such other clauses as FEMA may by <br />appropriate instructions require, and also a clause requiring the subcontractors to <br />include these clauses in any lower tier subcontracts. The prime contractor shall be <br />responsible for the compliance by any subcontractor or lower tier subcontractor <br />with all of these contract clauses. <br /> <br />Breach.
