<br /> <br />Hazard Mitigation Page 42 FEMA-DR-4393-0042 Orange County <br />Grant Agreement <br />D-19 <br /> <br />The RECIPIENT/SUBGRANTEE agrees that it will assist and cooperate <br />actively with the administering agency and the Secretary of Labor in <br />obtaining the compliance of contractors and subcontractors with the equal <br />opportunity clause and the rules, regulations, and relevant orders of the <br />Secretary of Labor, that it will furnish the administering agency and the <br />Secretary of Labor such information as they may require for the <br />supervision of such compliance, and that it will otherwise assist the <br />administering agency in the discharge of the agency's primary <br />responsibility for securing compliance. <br /> <br />The RECIPIENT/SUBGRANTEE further agrees that it will refrain from <br />entering into an y contract or contract modification subject to Executive <br />Order 11246 of September 24, 1965, with a contractor debarred from, or <br />who has not demonstrated eligibility for, Government contracts and <br />federally assisted construction contracts pursuant to the Executive Order <br />and will carry out such sanctions and penalties for violation of the equal <br />opportunity clause as may be imposed upon contractors and subcontractors <br />by the administering agency or the Secretary of Labor pursuant to Part II, <br />Subpart D of the Executive Order. In addition, the applicant agrees that if it <br />fails or refuses to comply with these undertakings, the administering <br />agency may take any or all of the following actions: Cancel, terminate, or <br />suspend in whole or in part this grant (contract, loan, insurance, guarantee); <br />refrain from extending any further assistance to the applicant under the <br />program with respect to which the failure or refund occurred until <br />satisfactory assurance of future compliance has been received from such <br />applicant; and refer the case to the Department of Justice for appropriate <br />legal proceedings. <br /> <br />(2) If any real property or structure thereon is provided or improved with the <br />aid of Federal financial assistance extended to the RECIPIENT/ <br />SUBGRANTEE, this assurance shall obligate the RECIPIENT/ <br />SUBGRANTEE, or in the case of any transfer of such property, any <br />transferee, for the period during which the real property or structure is used <br />for a purpose for which the Federal financial assistance is extended, or for <br />another purpose involving the provision of similar services or benefits; <br /> <br />(3) Titles VI and VII of the Civil Rights Act of 1964 (PL 88-352), and the <br />regulations issued pursuant thereto (prohibiting discrimination on the basis <br />of race, color, national origin and ensuring that individuals are employed, <br />and that employees are treated during employment, without regard to their <br />race, color, creed, national origin, sex or age); Any prohibition against <br />discrimination on the basis of age under the Age Discrimination Act of <br />1975, as amended (42 U.S.C. 6101 et. seq.) which prohibits discrimination <br />DocuSign Envelope ID: 26D0940B-F66D-4866-9C70-60056804E991DocuSign Envelope ID: B94E5F6B-897F-4461-A479-96F4BF459906DocuSign Envelope ID: 72D7F019-9C12-4921-8125-FCF8032A7011
