Attachment 2 <br /> The following voluntary conditions are being offered by the applicant: <br /> 1. Application: Project shall be completed as presented in approved site plan/application packet. <br /> Applications to rezone property to a Conditional District shall be processed in accordance with the <br /> procedures in UDO Section 2.9; <br /> 2. Off-Street Parking Requirements: No more than 34 off-street parking spaces shall be required <br /> rather than the required amount from UDO Table 6.9.7, one space for every 200 square feet of <br /> gross floor area for retail uses, which would total 54 spaces for this development; <br /> 3. Driveway Access: Shall adhere to the recommendations from the Traffic Impact Analysis in <br /> Attachment 1 (5), shall be responsive to NC Department of Transportation comments in <br /> Attachment 5 (6), and to the Orange County Transportation Services Department comments in <br /> Attachment 5 (4); <br /> 4. Resource Protection Area: Recognizing that the property is within a Resource Protection Area <br /> due to its proximity to the White Cross School, the north elevation of the building, towards NC <br /> Hwy 54, shall consist of the same treatment of cement fiber, lap siding, trim, crown, frieze, <br /> simulated windows, etc. as proposed for the front elevation in the submitted application; <br /> 5. Existing Building: Applicant will accept an offer from the community to remove the existing <br /> structure at no cost/liability to the applicant if a written and qualified offer is received soon after <br /> site plan approval and the existing structure is removed within a timeframe that will not impede <br /> development of the proposed project; <br /> 6. Fire Safety: Fire suppression needs shall be met by securing a deed of easement and <br /> agreement for use of the water source (3 acre pond) identified on Orange County PIN 9748-28- <br /> 3016.
