183 <br /> ORANGE COUNTY <br /> DEED OF EASEMENT <br /> AND AGREEMENT <br /> NORTH CAROLINA (Water Source) <br /> THIS DEED OF EASEMENT and AGREEMENT, made this day of February, 2023, by and <br /> between Patricia w. Cecil, 2505 Wildcat Creek Road, Chapel Hill, North Carolina 27518 ("Grantor"), and <br /> (the "Grantee"); <br /> WITNESSETH: <br /> WHEREAS, Grantor is the owner of certain real property located on Wildcat Creek Road in Bingham <br /> Township, consisting of approximately 31.84 acres of land more particularly described in a deed recorded at <br /> Dee4d Book 416, page 1 in the Orange County Registry, on which there is currently an approximately 3.0 acre <br /> pond and identified as Orange County PIN 9748-28-3016 (the "Property"); <br /> WHEREAS, the Grantee plans to develop and build a commercial structure on a nearby approximately <br /> 4.83 parcel located at having Orange County PIN 9749-40-2351 ("Grantee's Property"), and requires a source <br /> of water for fire protection purposes with respect to structures to be built on Grantee's Property; and <br /> WHEREAS, Grantor is willing to grant and convey to Grantee, its successors and assigns an easement <br /> to draw water from the pond on the Property as a source of water for firefighting purposes, only, for the benefit <br /> of Grantee's Property and for no other property or purpose. <br />
