Revised 06/21 8 <br />Article 11A and Article 40 of North Carolina General Statute Chapter 66. <br /> <br />j. Force Majeure. Neither party shall be liable to the other for any failure or delay or <br />performance of any obligation under this Agreement to the extent such failure or delay <br />shall have been wholly or principally caused by force majeure acts or events beyond its <br />reasonable control rendering performance illegal or impossible. As used in this section, <br />“force majeure” means any cause beyond the reasonable control of a party including, but <br />not limited to, an act of God, nature, act of aggression, fire, strike, flood, riot, war, delay <br />of transportation, terrorism, pandemics, or other widespread outbreaks of infectious <br />diseases or inability due to the aforementioned causes to obtain necessary labor, material <br />or facilities. <br /> <br />k. Notices.
