45 <br /> A. SCHOOLS ADEQUATE PUBLIC FACILITIES ORDINANCE INTRODUCTORY INFORMATION <br /> 1. Background <br /> ■ The Schools Adequate Public Facilities Ordinance (SAPFO) and two <br /> Memorandums of Understanding were adopted in 2003 between Orange <br /> County, Chapel Hill, Carrboro, and Chapel Hill-Carrboro City Schools <br /> (CHCCS) and Orange County, Hillsborough, and Orange County Schools <br /> (OCS). <br /> ■ The purpose of SAPFO is to ensure that new residential growth within the <br /> county occurs at a pace that allows the County and school districts to provide <br /> adequate school facilities to serve students from the new developments. The <br /> ordinance identifies the school districts as being responsible for planning and <br /> constructing new school facilities, Orange County being responsible for <br /> funding the new school facilities, and the local government being responsible <br /> for monitoring development impacts and timing. <br /> ■ The ordinance provides guidelines for determining a projected student growth <br /> rate methodology and student generation rate and collecting annual student <br /> membership and building capacity reports. <br /> ■ Additionally, the ordinance outlines criteria for maintaining a two part system <br /> including: <br /> 1) Capital Improvement Plan (CIP) linked to the needs identified by <br /> student projections and available capacity and <br /> 2) Issuing Certificate of Adequate Public Schools (CAPS) for new <br /> residential developments. <br /> 2. Capital Improvement Plan (CIP) <br /> ■ The ordinance calls for the development and maintenance of a Capital <br /> Improvement Plan for school construction based on historical growth patterns <br /> including school membership and building capacity (which could change <br /> based on building additions, revaluation of core capacity, revisions to the <br /> North Carolina Department of Public Instruction student class size and/or <br /> modifications to the Board of Education certified capacities). <br /> ■ SAPFOTAC Report <br /> 1) The ordinance also established a Schools Adequate Facility Ordinance <br /> Technical Advisory Committee (SAPFOTAC) which produces an Annual <br /> Report documenting, among other things, projected future student <br /> membership and school capacity needs over a 10-year period. This <br /> process also includes review, comment, and acknowledgement by the <br /> local governments. <br /> 2) SAPFOTAC report also monitors and reports on changes in class size <br /> averages at the state level, charter school enrollment and impacts, future <br /> school construction projects, and major residential development projects. <br /> November Orange County requests student membership and capacity numbers <br /> December BOCC accepts membership and capacity numbers <br /> December - March Student membership and projections are utilized during the budget process <br /> January SAPFOTAC meets to review draft report and 10-year student projections <br /> March Draft report distributed to SAPFO partners for comment <br /> April Draft report and 10-year student projections presented to elected officials <br /> May Final report is certified by the BOCC <br />
