The proposed LIDO amendments proposed now <br /> seek to specifically: <br /> • Ensure that County regulations are consistent with NCGS Chapter 160D-804.1, related <br /> to the acceptance of Performance Guarantees; <br /> • Update existing E&SC and Stormwater Management regulations to coincide with 15A <br /> North Carolina Administrative Code (NCAC) Chapter 4: Sedimentation Control Rules, <br /> 15A NCAC 02H .1000 through .1062: Stormwater Management Rules, the most current <br /> North Carolina Department of Environmental Quality (NCDEQ) Erosion and Sediment <br /> Control Planning and Design Manual, and the most current version of the NCDEQ <br /> Stormwater Design Manual; <br /> • Ensure that County implementation of its delegated Local Programs for E&SC and <br /> Stormwater Management conforms with the NCDEQ's most current Rules and Model <br /> Ordinances related to E&SC and Stormwater Management; <br /> • Clarify/refine County requirements for Stormwater Control Measure (SCM) Performance <br /> Guarantees; <br /> • Clarify/refine County requirements for annual SCM monitoring and 5-year inspections, <br /> and eliminate unenforceable County requirements for SCM maintenance guarantees; <br /> • Provide more equitable Land Disturbing Permit (aka "grading permit") timeframes; and <br /> • Update E&SC and Stormwater Management terms, definitions, and standards to be <br /> consistent with the most current North Carolina NCDEQ rules/guidance. <br /> Joint Planning Area (JPA) Review: In accordance with the Joint Planning Agreement with the <br /> Towns of Chapel Hill and Carrboro, the UDO amendment package was sent to Town staffs on <br /> July 30, 2021, April 12, 2022, and April 25, 2022. The Town of Chapel Hill staff sent the <br /> comments contained in Attachment 6 on April 18, 2022. The Town of Carrboro planning staff <br /> sent the memorandum contained in Attachment 6 on May 16, 2022. Both Town staffs found no <br /> inconsistency with the Joint Planning Area Land Use Plan. <br /> Planning Board Recommendation: The Planning Board reviewed this item at its May 4, 2022 <br /> regular meeting and its September 7, 2022 regular meeting. At the September 7, 2022 regular <br /> meeting, the Planning Board voted unanimously to recommend approval of the amendments. <br /> An excerpt of the approved minutes from the May 4, 2022 meeting are included in Attachment <br /> 4. An excerpt of draft minutes from the September 7, 2022 meeting and the signed Statement <br /> of Approval and Consistency are included in Attachment 5.
