25 <br /> (1) Erosion and Sedimentation Control PlansPlAns may be disapproved unless <br /> accompanied by an authorized statement of financial responsibility and <br /> documentation of property45 ownership. This statement shall be signed by the <br /> Financially Responsible Party46 for the ';;Ad- <br /> Land-Disturbing Activity or his/hero' attorney-in-fact. <br /> (2) The statement shall include the mailing and street addresses of the principal <br /> place of business of: (1) the POPSGA fiAaAGially rQSPOAGiblaFinancially <br /> Responsible Party, (2) the owner of the land, and (3) any registered agents. <br /> (3) If the Financially Responsible Party is not a <br /> resident of North Carolina, a North Carolina agent must be designated in the <br /> statement for the purpose of receiving notice of compliance or non-compliance <br /> with the planErosion and Sedimentation Control Plan, the North Carolina <br /> Sedimentation Pollution Control Act of 1973, this Ordinance -or rules or orders <br /> adopted or issued pursuant to this Ordinance. <br /> (4) If the applicant is not the owner of the land to be disturbed, the draft €r,@RMAA <br /> Erosion and Sedimentation Control Plante must include the owner's <br /> written consent for the applicant to submit a draft Frei^^ Erosion and <br /> Sedimentation Control PIanCAPtmI Plap and to conduct the anticipated laad- <br /> distwrbiAq Activity. <br /> (4}(5) If the applicant is not the owner of the land to be disturbed and the anticipated <br /> Land-Disturbing Activity involves the construction of utility lines for the provision <br /> of water, sewer, gas, telecommunications, or electrical service, the draft Erosion <br /> and Sedimentation Control Plan may be submitted without the written consent of <br /> the owner of the land, so long as the owner of the land has been provided prior <br /> notice of the project.48 <br /> 2.19.4 Review by the Soil &Water Conservation District <br /> (A) The Orange Soil and Water Conservation District shall review the Emgio,i^^n Erosion and <br /> Sedimentation Control PlanCAptrol Rlao and submit any comments and <br /> recommendations to the Erosion Control Officer within 20 days after the Soil and Water <br /> Conservation District received the€-res'ApErosion and Sedimentation Control Plan, or <br /> within any shorter period of time as may be agreed upon by the District and the Erosion <br /> Control Officer. <br /> (B) Failure of the Soil and Water Conservation49 District to submit its comments and <br /> recommendations to the Erosion Control Officer within 20 days or any agreed- upon <br /> shorter period of time shall not delay final action on theFri^n Erosion and <br /> Sedimentation Control PlanC_^^+ l Plan <br /> 2.19.5 Review and Response to Erosion and Sedimentation Control Plans <br /> (A) Once an Erosion and Sedimentation Control Plan has been submitted to Orange County, <br /> the Erosion Control Officer shall determine whether the submittal <br /> contains the required components as defined in Section 2.19.3 of this Ordinance50 and <br /> shall confirm the appropriate review fees within five (5) business days. The Erosion <br /> Control Officer shall subsequently inform the applicant in writing of plan acceptance or <br /> plan rejection, and of the appropriate review fees.
