128 <br /> ARTICLE 9: ENFORCEMENT <br /> miff n20 01 <br /> This Article provides for the methods of notification and penalties involved in enforcement of this <br /> Ordinance. Whenever possible, it is desirable to gain voluntary compliance with the provisions of this <br /> Ordinance without the necessity of pursuing formal enforcement measures. <br /> VIOLATIONS <br /> 9.2.1 Violations Specifically <br /> Unless lawfully exempted, the following uses or actions shall be considered a violation: <br /> (A) To use land or buildings inconsistent with the requirements of this Ordinance; <br /> (B) To erect a building or structure inconsistent with the requirements of this Ordinance; <br /> (C) To develop or subdivide land inconsistent with the standards of this Ordinance; <br /> (D) To subdivide, transfer, or sell land by reference to a subdivision plat prior to plat approval <br /> and recordation as provided in Articles 2 and 7 . The description of metes and bounds in <br /> the instrument of transfer or other document used in the process of selling or transferring <br /> land does not exempt the transaction from this Ordinance; <br /> (E) To record a plat of any subdivision prior to approval of the plat as provided in Article 2; <br /> (F) To install or use a sign inconsistent with the requirements of Section 6.12; <br /> (G) To engage in the use of a building or land, the use or installation of a sign, the <br /> subdivision or development of land, or any other activity requiring one or more permits or <br /> approvals under this Ordinance without obtaining all required permits or approvals; <br /> (H) To engage in the use of a building or land, the use or installation of a sign, the <br /> subdivision or development of land or any other activity requiring one or more permits <br /> under this Ordinance in any way inconsistent with any permit or approval and/or any <br /> conditions imposed; <br /> (1) To engage in new development activities without an approved Firesiop <br /> Erosion and Sedimentation Control Plan359 and/or Stormwater <br /> Management Plan (SMP); <br /> (J) To violate the terms of any permit or approval granted under this Ordinance or any <br /> condition imposed on such permit or approval including, but not limited to, Special Use <br /> Permits; <br /> (K) To obscure, obstruct or destroy any notice required to be posted or otherwise given <br /> under this Ordinance; <br /> (L) To violate any lawful order issued under this Ordinance; or <br /> (M) To continue any violation of this Ordinance. <br /> 9.3.1 Specifically <br /> The following shall be considered violators of the Ordinance and subject to enforcement: <br /> 319 "Erosion Control Plan"replaced with "Erosion and Sedimentation Control Plan"as defined in15ANCAC <br /> 02H.1002(Definitions)—NOTE. "Erosion and Sedimentation Control Plan"is integrated through the remainder of <br /> Article 9,where applicable. <br /> Orange County, North Carolina— Unified Development Ordinance Page 9-1 <br />
