7 <br /> 1 conventional district allowing for development of "enterprises engaged in manufacturing, <br /> 2 processing, creating, repairing, renovating, painting, cleaning, and assembling of goods, <br /> 3 merchandise, or equipment." <br /> 4 <br /> 5 In acting on a conventional district rezoning request, the County is unable to impose conditions <br /> 6 and the applicant is not required to define how the property may be used or developed. If <br /> 7 approved, all land uses permitted within the I-2 district could be developed on the property, <br /> 8 consistent with applicable regulations. Conventional district rezoning decisions are based on <br /> 9 the BOCC's legislative determination that the request is consistent with the purpose and intent <br /> 10 of the Comprehensive Plan. <br /> 11 <br /> 12 A formal site plan must be submitted, reviewed and approved by staff prior to any development <br /> 13 activity on the parcel, in accordance with Section 2.5 of the Unified Development Ordinance <br /> 14 (UDO). <br /> 15 <br /> 16 Proposal: The applicant is requesting the conventional zoning district for the parcel with PIN <br /> 17 9844-88-7024 be changed from R-1 to 1-2 stating: <br /> 18 "The requested zoning change promotes the desired use according to adjoining use and <br /> 19 the Orange County long-range planning information, and is consistent with the existing <br /> 20 uses in the area. The requested change from R-1 to 1-2 zoning is requested to <br /> 21 accommodate these uses consistent with the promotion of economic improvements in <br /> 22 the area. Proposed uses and development plans for projects will be designed and <br /> 23 reviewed in accordance and consistent with the Unified Development Ordinance <br /> 24 requirements and permitted uses. This proposed zoning change promotes benefits for <br /> 25 allowing uses in an area which are not currently available under the current zoning, while <br /> 26 protecting the surrounding public interest via the notification and rezoning process." <br /> 27 <br /> 28 Public Notification: In accordance with Section 2.8.7 of the UDO, notices were mailed on <br /> 29 August 22, 2022, 15 days before the Public Hearing, via first class mail to property owners <br /> 30 within 1,000 feet of the subject parcel, providing the date/time of the Public Hearing where the <br /> 31 proposal is to be reviewed. Staff also posted the subject parcel with signs indicating the <br /> 32 date/time of the Public Hearing on the rezoning request on August 23, 2022. Approved <br /> 41 minutes from the meeting and the signed Statement of Consistency are included in Attachment <br /> 42 4 and meeting materials are available at: http://orangecountync.gov/AgendaCenter/Planning- <br /> 43 Board-26. One member of the public attended the Planning Board meeting and spoke against <br /> 44 the rezoning. Planning staff did not receive any phone calls or written comments prior to the <br /> 45 Planning Board meeting. <br /> 46 <br /> 47 Planning Director's Recommendation: As required under Section 2.8.5 of the UDO, the <br /> 48 Planning Director is required to `... cause an analysis to be made of the application and, based <br /> 49 upon that analysis, prepare a recommendation for consideration'.
