1 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> Meeting Date: September 6, 2022 <br /> Action Agenda <br /> Item No. 8-k <br /> SUBJECT: Amendment to the Contracts of the Attorney and Clerk <br /> DEPARTMENT: County Attorney, Clerk to the <br /> Board <br /> ATTACHMENT(S): INFORMATION CONTACT: <br /> John Roberts, County Attorney, 245- <br /> 2318 <br /> Laura Jensen, Clerk to the Board, 245- <br /> 2130 <br /> PURPOSE: To amend the contracts of the employees directly hired by the Board of <br /> Commissioners to clarify retirement benefits. <br /> BACKGROUND: In advance of the 2022 performance evaluations of the Clerk, Manager, and <br /> Attorney, the County Attorney noticed that retirement benefits are not adequately specified in <br /> the contract documents for two of these employees. (the county manager received a separate <br /> retirement benefit in 2019.) Specifically, the documents are lacking language that the two <br /> employees are to receive the same access to the same retirement benefits available to other <br /> County employees with similar time employed with Orange County. If satisfactory to the Board, <br /> the following change to the contract language would accomplish this goal. <br /> From: <br /> SECTION 11: RETIREMENT <br /> Employee will continue to participate in the North Carolina Local Governmental <br /> Employees Retirement System, with the County contributing the employer's share to that <br /> retirement program at a rate consistent with other county employees. <br /> To: <br /> SECTION 11: RETIREMENT <br /> Employee will participate in the North Carolina Local Governmental Employees' <br /> Retirement System, with the County contributing the employer's share to that retirement <br /> program at a rate consistent with other County employees. Should Employee retire from <br /> Orange County, the Employee shall receive the same Orange County retirement and <br /> retiree health benefits available to other County employees per Orange County Code of <br /> Ordinances Section 28-36 as adopted at the time of this Amendment. <br /> FINANCIAL IMPACT: There is no immediate financial impact associated with this action. <br /> SOCIAL JUSTICE IMPACT: There is no Orange County Social Justice Goal impact associated <br /> with this item. <br />
