16 <br /> The Ordinance Review Committee (ORC) reviewed a previous version of these UDO <br /> amendments at the August 4, 2021 Planning Board meeting (see meeting notes in Attachment <br /> 3). The Planning Board subsequently reviewed an updated version of these UDO amendments <br /> that had not yet received Legal Sufficiency Review at the May 4, 2022 Planning Board meeting <br /> (see meeting minutes in Attachment 4). This most current version includes everything previously <br /> presented to the ORC and the Planning Board and addresses all Legal Sufficiency Review <br /> comments. <br /> The proposed UDO amendments specifically seek to: <br /> • Revise performance guarantee requirements for both subdivisions and stormwater <br /> management; <br /> • Provide more equitable Land Disturbing Permit (aka grading permit) timeframes; and <br /> • Update erosion and sedimentation control and stormwater management terms, definitions, <br /> requirements and standards so they are consistent with the most current North Carolina <br /> Department of Environmental Quality (NCDEQ) rules/guidance. <br /> The UDO amendment packet in Attachment 2 has incorporated Legal Sufficiency Review <br /> comments received to date; however, the Orange County Staff Attorney has not yet <br /> confirmed his acceptance of how the Legal Sufficiency Review comments have been <br /> addressed. In order to maintain forward momentum in taking the amendments through the <br /> established process, the proposed amendments would not come back to the Planning Board for <br /> further review if the on-going review process were to result in only minor edits that do not affect <br /> the substance of the regulations. <br /> Joint Planning Area (JPA) Review: In accordance with the Joint Planning Agreement with the <br /> Towns of Chapel Hill and Carrboro, the amendment package was sent to Town staffs on April 12, <br /> 2022 and again on April 25, 2022. Comments from the Town of Chapel Hill were received on <br /> April 18, 2022 and comments from the Town of Carrboro were received on May 16, 2022. All JPA <br /> comments received to date have been addressed (see Town comments in Attachment 5). <br /> Planning Director's Recommendation: The Planning Director recommends approval of the: <br /> 1. Statement of Approval and Consistency indicating the text amendments are reasonable <br /> and in the public interest, as contained in Attachment 1. <br /> 2. Amendments to the Unified Development Ordinance (UDO), as contained in <br /> Attachment 2. <br /> FINANCIAL IMPACT: Existing County staff has and will continue to accomplish the necessary <br /> tasks associated with updating the UDO in response to the State legislation. <br /> RECOMMENDATION(S): The Planning Director recommends the Board: <br /> 1. Review the proposed UDO text amendments and deliberate as desired, <br /> 2. Consider the Planning Director's Recommendation, and <br /> 3. Make a recommendation to the BOCC on the Statement of Approval and Consistency <br /> (Attachment 1) and the proposed UDO text amendments (Attachment 2) in time for the <br /> October 3, 2022 BOCC meeting / public hearing. <br />
