Article 6: Development Standards 111 <br /> Section 6.15:Soil Erosion and Sedimentation Contro1268F <br /> (1) The person(s) conducting the Wnd-disturbipg t'41-and-Disturbing Activity <br /> need not submit an Frosmon Qg^ ic,^ ;a.,� r.,4d0„o.t;a-to p f Qntrol ola^Erosion and <br /> Sedimentation Control Plan if such person obtains an <br /> Erosion and Sedimentation Control Plan <br /> Waitewaiver from the Erosion Control Division. <br /> (2) An application for this waiver shall be submitted to the Erosion Control Officer <br /> and shall contain the following: <br /> (a) The name, address, and phone number of the developer and owner, <br /> (b) A description and drawing of the proposed development or' Land- <br /> Disturbing Activity, <br /> (c) The location of the development, and <br /> (d) Any other information requested by the Orange County Erosion Control <br /> Officer that is reasonably necessary to evaluate the proposed <br /> development. <br /> (3) The Erosion Control Officer shall issue the <br /> RlanErosion and Sedimentation Control Plan W;;WA waiver if he/she finds the <br /> following: <br /> (a) The Land-Disturbing Activity will not result in the <br /> uncovering of more than 10,000 square feet; and <br /> (b) The Land-Disturbing Activity is not to be <br /> conducted in connection with any of the following types of developments: <br /> (i) Shopping centers, <br /> (i i) Industrial and commercial facilities, <br /> (iii) Major subdivisions, <br /> (iv) Roads, or <br /> (v) Any activity involving the temporary or permanent storage <br /> (above or below ground) of any noxious, toxic, or hazardous <br /> substance, including fuel storage facilities. <br /> (c) The proposed Land-Disturbing Activity will not: <br /> (i) Significantly increase or decrease the rate or volume of surface <br /> water runoff, <br /> (i i) Significantly contribute to the degradation of water runoff, <br /> (iii) Have a significant adverse impact on a wetland, watercourse, or <br /> water supply reservoir; <br /> (iv) Occur within a buffer area circumscribing a water supply <br /> reservoir - or <br /> (v) Involve open burning of trees, limbs, stumps and construction <br /> debris associated with the permitted activity. <br /> 6.15.7 Design and Performance Standards <br /> (A) Basic Control Objectives <br /> An Erosion and Sedimentation Control Plan may be disapproved pursuant to Section <br /> 2.19 of this Ordinance if the Erosion and <br /> Sedimentation Control Plan fails to address the following control objectives: <br /> (1) Identify Critical Areas <br /> Orange County, North Carolina— Unified Development Ordinance Page 6-121 <br />
