Article 6: Development Standards 107 <br /> Section 6.15:Soil Erosion and Sedimentation Contro1268F <br /> (c) To encourage the protection of natural systems and the utilization of <br /> these systems in a manner which does not impair their beneficial <br /> functioning. <br /> (d) To discourage the construction of drainage systems which do not <br /> functionally approximate the natural drainage pattern. <br /> (e) To minimize sedimentation and erosion, within the watersheds, and as a <br /> result, minimize the transport of sediment and pollutants. <br /> (f) To protect and maintain the existing habitat of fish and wildlife. <br /> (g) To prevent damage from flooding while recognizing that natural <br /> fluctuations in water levels are beneficial. <br /> (h) To protect the absorptive, purifying and retentive functions of the natural <br /> systems existing in the University Lake, Cane Creek, and Upper Eno <br /> Watersheds area. <br /> (i) To ensure the attainment of these objectives by requiring the approval <br /> and implementation of <br /> Erosion and Sedimentation Control <br /> Plans270 for all activities which may adversely affect the University Lake, <br /> Cane Creek, and Upper Eno Watersheds. <br /> Q) To provide and enforce design and performance standards for control of <br /> post-development erosion and sedimentation in order to preserve the <br /> characteristics that existed in the University Lake, Cane Creek, and <br /> Upper Eno Watersheds Area prior to development. <br /> 6.15.2 Applicability <br /> (A) The 271 erosion and sedimentation control provisions contained herein shall apply <br /> within Orange County, including the municipalities of Carrboro, Hillsborough, and the <br /> portion of Mebane within Orange County, but excluding the municipal boundaries and <br /> planning extraterritorial limits of Chapel Hill.272 <br /> (B) It shall be unlawful, within the jurisdiction of this Section, to engage in lead-disurbing <br /> as#i 4Land-Disturbing Activity, except as provided herein, without first obtaining a wit <br /> Land Disturbing Permit (LDP)273 as required by this Section and without complying with <br /> the conditions of the issuance of said geg44LDP. <br /> (C) Any person engaged in land-disturbing activities who fails to file a-plangpply for an <br /> LDP274 in accordance with this Ordinance, or who conducts a <br /> astivltyLand-Disturbing Activity except in accordance with provisions of an approved plan <br /> LDP shall be deemed in violation of this Ordinance. <br /> 6.15.3 Erosion Control Standards <br /> (A) Orange County Erosion Contro1275 Standards <br /> 270 Consistentuse of"Erosion and Sedimentation Control Plans". <br /> 271 Deleted "soil". <br /> 272 Revised per NCDEQ peer review comment. <br /> 273 "Land Disturbing Permit"is correctly noted to match the Definitions section of this Ordinanceand the <br /> appropriate acronym for Land DisturbingPermit(LDP) is included-NOTE: "Land Disturbing Permit"and"LDP" <br /> are integrated through the remainder of Section 6.15,where applicable. <br /> 174 Cl a ri ficati on of requi rements. <br /> 275 Clarificationthatthis sub-section is specificto"Orange County erosion control standards" <br /> Orange County, North Carolina- Unified Development Ordinance Page 6-117 <br />
