Article 9: Enforcement 159 <br /> Section 9.8: Soil Erosion and Sedimentation Contro1356F <br /> (1) The Erosion Control Officer shall have the authority to require written statements, <br /> or the filing of reports under oath, with respect to pertinent questions relating to <br /> land-disturbing activities. <br /> (E) Authority to Revoke Land Disturbing Permits <br /> (1) The Erosion Control Officer shall have the authority to revoke Land Disturbing <br /> Permits issued by the Erosion Control Division as provided for within this <br /> Ordinance. <br /> (F) Stop Work Orders <br /> (1) Whenever any person Personis violating the 362erosion and sedimentation <br /> control provisions of this Ordinance or any rule or order adopted or issued <br /> pursuant to this Ordinance, or any term, condition, or provisions of an approved <br /> Erosion er„s'en and sedo e tatmOR GGRtF I Plan Erosion and Sedimentation <br /> Control Plan, the Erosion Control Officer may, either before or after the institution <br /> of any other action or proceeding authorized by these regulations, issue a stop <br /> work order for the site on which the violation has occurred. <br /> (2) Upon issuance of such an order and the posting of same on the site of the <br /> violation, all work on the site of the violation shall cease, except those activities <br /> necessary to bring the site into compliance with the 363erosion and <br /> sedimentation control provisions of this Ordinance. <br /> (3) Notice of the stop work order shall be in writing, directed to the person <br /> Personconducting the land disturbing ti"ityLand-Disturbinq Activity and shall <br /> state the reasons for the issuance of the order, and the conditions under which <br /> work may be resumed. <br /> (4) Notice shall be given by registered or certified mail. In the event service cannot <br /> be accomplished by registered or certified mail, it may be accomplished in any <br /> manner provided in rule 40) of the North Carolina Rules of Civil Procedure. <br /> (G) Self-Inspection & Report Procedures314 <br /> (1) The landowner, the fiRaRGially respeRsible pa4VFinancially Responsible Party, or <br /> their duly appointed agent shall perform an inspection of the area covered by the <br /> plan after each phase of the plan has been completed and after establishment of <br /> temporary ground cover in accordance with North Carolina General <br /> StatuteN.G.G.S 113A-57(2). <br /> (2) In addition, weekly and rain-event self-inspections are required by federal <br /> regulations that are implemented through the most current version of the NPDES <br /> Construction General Permit No. NCG 010000. Note that NPDES stabilization <br /> requirements may be more restrictive than the minimum state requirements. <br /> M(3) The peFser Person who performs the inspection shall maintain and make <br /> available a record of the inspection at the site of the land disturbing aGtivityLancl- <br /> Disturbing Activity. <br /> (3)(4) The record shall set out any significant deviation from the approved eresieR and <br /> sedimentation control plan Erosion and Sedimentation Control Plan, identify any <br /> measures that may be required to correct the deviation, and document the <br /> completion of those measures. <br /> (4)(5) The record shall be maintained until permanent ground cover has been <br /> established as required by the approved erosion and sediMeRtati n Gen+rel <br /> planErosion and Sedimentation Control Plan. <br /> 362 Deleted "soil". <br /> 363 Deleted "soil". <br /> 364 This section has been revised to comply with the state's current E&SC Model Ordinance. <br /> Orange County, North Carolina—Unified Development Ordinance Page 9-10 <br />
