Article 7: Subdivisions 149 Section 7.4: Improvements and Performance Guarantees IMPROVEMENTSSection 7.4: • 7.4.1 Generally (A) Improvements proposed by the subdivider or required by this Ordinance, shall be constructed in accordance with the standards and requirements provided in this Ordinance. (B) In those instances where said improvements are required to be constructed subsequent to the approval of the Final Plat, plans and specifications for said improvements shall be approved by the appropriate agency and reference to said improvements shall be made part of the Final Plat. 7.4.2 Improvements Required (A) Subdividers are responsible for the construction, installation, and maintenance of required improvements in accordance with the standards in this Ordinance in addition to any applicable federal, state, or county standards to include, but not be limited to, the following: (1) All roads within the subdivision and improvements to existing roads required for safe and adequate access to the subdivision; (2) Road signs; (3) Water supply and wastewater systems, other than individual wells and septic tanks; (4) Drainage facilities and easements; (5) Stormwater management devices; (6) Erosion and sedimentation control devices; (7) Low-impact (passive) and active recreation amenities; (8) Fire suppression management facilities; (9) Common Open Space, Recreation or Landscape management improvements, areas, and facilities; and (10) Any other on- or off-site improvements required by this Ordinance or required at the time of preliminary plat approval. (B) If the subdivider records a plat for only a portion of the subdivision for which a preliminary plat was approved, the improvements required to be constructed, installed, and maintained in accordance with said recorded plat shall be those improvements that the Planning Director deems necessary to serve the lots shown on the recorded plat. 7.4.3 Completion of Improvements (A) The Planning Director shall not approve a final plat presented for recordation until: (1) All required improvements have been completed. (2) All legal documents shall be submitted, reviewed and approved by the Orange County Attorney, or (3) A perfe-maRGe guaran Performance Guarantee347 has been provided in accordance with the provisions detailed herein. (B) An improvement shall be deemed completed only after the appropriate public agency has certified that the improvement(s) has been installed in accordance with the approved 347 Consistent us of"Performance Guarantee".
