1 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> Meeting Date: June 21, 2022 <br /> Action Agenda <br /> Item No. 8-u <br /> SUBJECT: Orange County Board of Adjustment Member Removal <br /> DEPARTMENT: Planning & Inspections <br /> ATTACHMENT(S): INFORMATION CONTACT: (919) <br /> Orange County Board of Adjustment Rules Patrick Mallett, Erosion Control and <br /> of Procedure Stormwater Supervisor, 245-2557 <br /> PURPOSE: To remove Scott Taylor as a member of the Orange County Board of Adjustment <br /> (BOA) as per Section IV of the Board of Adjustment Rules of Procedure. <br /> BACKGROUND: Mr. Scott Taylor was first appointed to serve as a member of the BOA on <br /> October 6, 2020, and his current term expires June 30, 2024. Since Mr. Taylor's appointment to <br /> the BOA, he has not attended meetings, and subsequently has not taken part in the participatory <br /> decision making process required by the BOA. <br /> On May 17, 2022, Interim Planning and Inspections Director Brenda Bartholomew sent an email <br /> to Scott Taylor advising Mr. Taylor that he currently held an appointed seat on the BOA. Ms. <br /> Bartholomew advised Mr. Taylor that based on non-compliance with the BOA Rules of <br /> Procedures, his resignation was requested. No resignation or response has been received to <br /> date. <br /> Section IV of the Board of Adjustment's Rules of Procedure states: <br /> D. Members of the Board may be removed for cause. <br /> E. Faithful attendance at all meetings of the Board and conscientious performance of the <br /> duties required of members of the Board shall be considered a pre-requisite of continuing <br /> membership on the Board. <br /> Given that a resignation was not forthcoming, it has been recommended that proceedings officially <br /> occur to remove Mr. Taylor from his appointed seat. It is important that BOA members are in <br /> attendance so that a legal quorum can be achieved and an equitable vote occur regarding matters <br /> presented to the BOA. <br /> FINANCIAL IMPACT: There is no financial impact associated with the removal of a current BOA <br /> member. <br />
