RP 10 00 10 21 <br /> <br /> <br /> <br />migration, release or escape of <br />"silica" or "silica-related dust". <br />b. Does not include any "pollution <br />conditions" to the extent that such <br />"pollution conditions" cause <br />"emergency response costs". <br />66. "Silica-related dust" means a mixture or <br />combination of "silica" and other dust or <br />particles. <br />67. "Specified subcontractor" means a <br />person, other than any "named insured's" <br />employee, or an organization, if such <br />person or organization agrees in a <br />written contract or agreement to perform <br />"covered operations". <br />68. "Specified subcontractor's insurance" <br />means any pollution liability insurance <br />available to the "specified subcontractor" <br />as a named insured for "covered <br />operations" and includes any deductible, <br />self-insured retention or coinsurance <br />obligation under that insurance. <br />69. "Superfund or other government-identified <br />contaminated site" means any premises, <br />site or location that: <br />a. Has been placed on, or proposed for, <br />the National Priorities List, any <br />Superfund list or any equivalent state, <br />tribal or local list, for or in the <br />United States of America, including <br />its territories and possessions and <br />Puerto Rico; or <br />b. Has been placed in, or proposed for, <br />the National Contaminated Site <br />Remediation Program, any similar <br />program or any equivalent provincial, <br />tribal or local program, for or in <br />Canada, including its territories and <br />possessions. <br />70. "Suspension" means: <br />a. The partial or complete cessation of <br />your "business activities"; or <br />b. That a part or all of a "covered <br />location" is rendered untenantable if <br />you lease such "covered location" to <br />others. <br />71. "Temporary worker" means a person who <br />is furnished to substitute for a permanent <br />"employee" on leave or to meet seasonal <br />or short-term workload conditions. <br />72. "Tort liability" means a liability that <br />would be imposed by law in the absence <br />of any contract or agreement. <br />73. "Transportation pollution conditions" <br />means any "pollution conditions": <br />a. That are not at, on, under or from a <br />"covered location"; and <br />b. That: <br />(1) Are from any "auto", rolling stock <br />or watercraft, while such "auto", <br />rolling stock or watercraft is being <br />used to transport the "pollutants", <br />or any property in which the <br />"pollutants" are contained, by the <br />"named insured", or by a carrier <br />on behalf of the "named insured", <br />to or from a "covered location" if <br />the transporter is properly licensed <br />to conduct such transportation, or <br />(2) Commence during the handling of <br />such "pollutants" or property for <br />"loading or unloading" in, on or <br />from such "auto", rolling stock or <br />watercraft. <br />74. "Your ECP coverage forms" means the <br />coverage forms that you have purchased, <br />as shown in Item 3. of the Travelers <br />ECP Custom Declarations. <br />If such coverage forms include any of <br />the following coverages, such coverage <br />is not considered to provide liability <br />coverage as used in this policy: <br />a. Contractors Professional Liability Loss <br />Mitigation Expenses Coverage. <br />b. Contractors Pollution Loss Mitigation <br />Expenses Coverage. <br />c. Contractors Indemnity For Design <br />Professional's Liability Coverage. <br />d. Contractors Indemnity For Sub- <br />contractor's Pollution Liability Coverage. <br />e. Crisis Management Services Expenses <br />For Pollution Liability Coverage. <br />75. "Your contractor professional services": <br />a. Means any of the following services: <br />(1) Architect, engineer or surveyor <br />professional services, including: <br />(a) Design and value engineering; <br />and <br />(b) Professional services of: <br />(i) A landscape architect; <br />(ii) A land surveyor or planner; <br />or <br />(iii) An interior designer or <br />space planner; <br />(2) Scientific or technical consulting <br />services; or <br />(3) Construction management, program <br />management, project management <br />or owner's representation services <br />for a project on which the "named <br />insured" serves as a construction <br />DocuSign Envelope ID: E0C7DD5C-4FA6-4C9E-85B9-3CA337445269
