Page 23 of 37 <br /> <br /> <br /> <br />(2) Ends with the earliest of: <br />(a) The date when the "covered <br />location" reasonably should be <br />restored to a condition which <br />allows the resumption of <br />"business activities"; <br />(b) The date when "business <br />activities" are resumed at a <br />new permanent location; or <br />(c) The last "business day" of the <br />Maximum Period Of Restoration <br />For Business Interruption For <br />On-Site Pollution Clean-Up <br />Costs Losses shown for the <br />Site Pollution Liability <br />Coverage Form - Claims-Made <br />in Item 3. of the Travelers <br />ECP Custom Declarations. If a <br />number of "business days" is <br />not shown for such Maximum <br />Period Of Restoration in the <br />Travelers ECP Custom <br />Declarations, that Maximum <br />Period Of Restoration will be <br />30 "business days". <br />b. Does not include any increase in the <br />length of time needed for you to <br />resume "business activities" caused <br />by interference by any of your <br />"employees" or any other person. <br />c. Will not be cut short by the end of <br />the "policy period". <br />14. "Business interruption waiting period" <br />means the number of "business days" <br />shown as the Waiting Period For <br />Business Interruption For On-Site <br />Pollution Clean-Up Costs Losses for the <br />Site Pollution Liability Coverage Form - <br />Claims-Made in Item 3. of in the <br />Travelers ECP Custom Declarations that <br />must elapse after there is a necessary <br />"suspension" of "business activities" as <br />a result of the "pollution conditions". If <br />a number of "business days" is not <br />shown for such Waiting Period in the <br />Travelers ECP Custom Declarations, that <br />Waiting Period will be 10 "business <br />days". <br />15. "Claim" means: <br />a. For the purposes of any Contractors <br />Professional Liability Coverage, a <br />written demand alleging liability on <br />the part of the "insured" for "loss" <br />caused by an act, error or omission. <br />b. For the purposes of any Contractors <br />Indemnity For Design Professional's <br />Liability Coverage, a written demand <br />alleging liability on the part of the <br />"design professional" for "loss" <br />caused by an act, error or omission. <br />c. For the purposes of any Contractors <br />Indemnity For Subcontractor's <br />Pollution Liability Coverage, a written <br />demand alleging liability on the part <br />of the "specified subcontractor" for <br />"loss" caused by "pollution <br />conditions". <br />d. For the purposes of any "Pollution <br />Liability Coverage", a written demand, <br />notice, or assertion of a legal right, <br />including a civil, or governmental <br />administrative or regulatory proceeding, <br />alleging liability on the part of the <br />"insured" for "loss" caused by <br />"pollution conditions". <br />16. "Contractor waste non-owned disposal <br />site pollution conditions" means "non- <br />owned disposal site pollution conditions" <br />that are a discharge, dispersal, seepage, <br />migration, release or escape of waste <br />that originated from a job site while <br />"covered operations" are being performed <br />at such job site. <br />17. "Covered location" means any location <br />listed as a Covered Location for the Site <br />Pollution Liability Coverage Form - <br />Claims-Made in Item 3. of the Travelers <br />ECP Custom Declarations. <br />18. "Covered non-owned disposal site" <br />means any "disposal site" that: <br />a. Is not, and was not at any time, <br />owned or operated by any "insured"; <br />b. Is located in the United States of <br />America (including its territories and <br />possessions), Puerto Rico or Canada; <br />c. At the time such site received the <br />"named insured's" waste that is <br />involved in the "non-owned disposal <br />site pollution conditions": <br />(1) Was properly authorized, by being <br />granted a license or permit, to <br />accept and dispose of that type of <br />waste; and <br />(2) Was in compliance with all <br />applicable federal, state, provincial, <br />tribal or local laws, regulations or <br />statutes, or governmental, judicial <br />or administrative orders or <br />directives; <br />d. At the time such site received the <br />"named insured's" waste that is <br />involved in the "non-owned disposal <br />site pollution conditions", was not <br />subject to any Federal Information <br />request made to any person or <br />organization under Section 104(e) of <br />the Comprehensive Environmental <br />Response, Compensation and Liability <br />Act or any of its amendments or <br />Section 3007(a) of the Resource <br />DocuSign Envelope ID: E0C7DD5C-4FA6-4C9E-85B9-3CA337445269
