For the purposes of any Contractors <br />Indemnity For Subcontractor's <br />Pollution Liability Coverage, a <br />"specified subcontractor" if the <br />amount of that limit of liability is not <br />less than the "required specified <br />subcontractor's insurance", unless we <br />have given you our prior written <br />consent to the amount of that limit <br />of liability before the "pollution <br />conditions" involved in the "loss" <br />commences. <br />4. "Auto" means: <br />a. A land motor vehicle, trailer or <br />semitrailer designed for travel on <br />public roads, including any attached <br />machinery or equipment; or <br />b. Any other land vehicle that is subject <br />to a compulsory or financial <br />responsibility law, or other motor <br />vehicle insurance law, where it is <br />licensed or principally garaged. <br />However, "auto" does not include <br />"mobile equipment". <br />5. "Auto transportation pollution conditions" <br />means any "pollution conditions" that: <br />a. Arise out of the ownership, <br />maintenance, use or entrustment to <br />others of any "auto" owned or <br />operated by or rented or loaned to <br />any "insured" that: <br />(1) Is being used to transport the <br />"pollutants", or any property in <br />which the "pollutants" are <br />contained, to or from a job site <br />where "covered operations" are <br />being performed; and <br />(2) Is not located within the <br />boundaries of a job site where <br />"covered operations" are being <br />performed; and <br />b. Commence during such transportation <br />or during the "loading or unloading" <br />of such "auto". <br />6. "Bodily injury": <br />a. Means any harm, including sickness or <br />disease, to the health of a person and <br />including death resulting therefrom. <br />b. Includes mental anguish, injury or <br />illness, or emotional distress. <br />"Loss" because of "bodily injury" <br />includes reasonable and necessary <br />expenses incurred to perform medical <br />monitoring for physical harm, including <br />sickness or disease, to the health of a <br />person. <br />7. "Boundaries" includes above or below <br />ground areas for a "covered location" <br />that are above or below the area of the <br />ground that is within the boundary lines <br />of such "covered location". <br />8. "Building information modeling services" <br />means the creation, maintenance, use or <br />modification of, or input into, any digital <br />model or digital representation that is <br />part of a computer-assisted design or <br />drafting system or program. <br />9. "Business activities" means: <br />a. Your regular business activities <br />occurring at a "covered location"; and <br />b. The tenantability of a "covered <br />location" if you lease such "covered <br />location" to others. <br />10. "Business day" means a day that you are <br />normally open for business. <br />11. "Business income" means the sum of the <br />following: <br />a. Net Income (Net Profit or Loss before <br />income taxes) that would have been <br />earned from or incurred for a <br />"covered location", including rental <br />income from any tenants if you lease <br />such "covered location" to others; <br />and <br />b. Continuing normal operating expenses <br />incurred, including payroll. <br />12. "Business interruption loss" means: <br />a. Actual loss of "business income" you <br />sustain due to the necessary <br />"suspension" of "business activities" <br />at a "covered location" during the <br />"business interruption period of <br />restoration"; and <br />b. Reasonable and necessary expenses <br />that the you incur after the "pollution <br />conditions" commenced to reduce <br />actual loss of "business income" that <br />would be otherwise covered under <br />Business Interruption For On-Site <br />Pollution Clean-Up Costs Losses in <br />Site Pollution Liability Coverage, but <br />only up to the amount that such loss <br />of "business income" we would <br />otherwise pay is actually reduced. <br />13. "Business interruption period of <br />restoration": <br />a.
