We are not obligated to make any <br />inspections, surveys, reports or <br />recommendations, and any such <br />actions taken relate only to <br />insurability and the premiums charged. <br />We do not make safety inspections <br />or undertake to perform the duty of <br />any person or organization to provide <br />for the health or safety of workers or <br />the public. And we do not warrant <br />that conditions, property or <br />operations: <br />(1) Are safe or healthful; or <br />(2) Comply with laws, regulations, <br />codes or standards. <br />c. You agree to provide us with: <br />(1) Access to: <br />(a) The locations where "covered <br />operations" are being or have <br />been performed under any <br />Contractors Pollution Liability <br />Coverage, any Contractors <br />Asbestos Pollution Liability <br />Coverage and any Non-Owned <br />Disposal Site Pollution Legal <br />Liability Coverage; <br />(b) The locations where "your <br />contractor professional <br />services" are being or have <br />been performed under any <br />Contractors Professional <br />Liability Coverage; or <br />(c) Any "covered location" under <br />any Site Pollution Liability <br />Coverage and any Non-Owned <br />Disposal Site Pollution Legal <br />Liability Coverage; <br />(2) Records pertaining to: <br />(a) The "covered operations" under <br />any Contractors Pollution <br />Liability Coverage, any <br />Contractors Asbestos Pollution <br />Liability Coverage and any Non- <br />Owned Disposal Site Pollution <br />Legal Liability Coverage; <br />(b) "Your contractor professional <br />services" under any Contractors <br />Professional Liability Coverage; <br />or <br />(c) Any "covered location" under <br />any Site Pollution Liability <br />Coverage and any Non-Owned <br />Disposal Site Pollution Legal <br />Liability Coverage; and <br />(3) Access to employees and other <br />appropriate personnel or <br />representatives, that are necessary <br />for us to conduct such inspections <br />and surveys. <br />d. Paragraphs a. and b. above apply to <br />us and any rating, advisory, rate <br />service, technical consulting or similar <br />organization which makes insurance <br />inspections, surveys, reports or <br />recommendations. <br />6. International Condition - Currency <br />a. Payments for premiums and <br />deductible amounts made to us will <br />be in the currency of the United <br />States of America unless we agree <br />that these payments may be made in <br />a different currency. <br />b. Payments for "loss" and "defense <br />expenses", or any payments we make <br />under any Supplemental Coverages <br />Endorsement issued by us as part of <br />this policy, will be in the currency of <br />the United States of America. At our <br />sole option, we may make these <br />payments in a different currency. Any <br />necessary currency conversion for <br />such payments will be calculated <br />based on the rate of exchange <br />published in the Wall Street Journal <br />immediately preceding the date the <br />payment is processed. <br />7. Legal Action Against Us <br />No person or organization has a right <br />under this policy: <br />a. To join us as a party or otherwise <br />bring us into a legal action asking for <br />"loss" against any "insured"; <br />b. To bring a legal action against us <br />under this policy unless all terms of <br />this policy have been fully complied <br />with; or <br />c. To bring a legal action against us to <br />recover "loss" unless your obligation <br />to pay such "loss" has been fully <br />determined either by a final judgment <br />or arbitration award or by written <br />agreement you, us and the claimant, <br />but we will not be liable for any <br />"loss" that is not payable under the <br />terms of this policy or that is in <br />excess of the applicable limit of <br />insurance. <br />Under any Contractors Indemnity For <br />Design Professional's Liability Coverage: <br />a. No one, other than you, can sue us to <br />recover "loss" under Contractors <br />Indemnity For Design Professional's <br />Liability Coverage; and <br />b.
