Page 17 of 37 <br /> <br /> <br /> <br />Indemnity For Subcontractor's Pollution <br />Liability Coverage. <br />The Self-Insured Retention For <br />Contractors Indemnity For Subcontractor's <br />Pollution Liability Coverage cannot be <br />paid by amounts other than "loss" that <br />would have been covered by Contractors <br />Indemnity For Subcontractor's Pollution <br />Liability Coverage in the absence of that <br />self-insured retention. <br />3. You will be financially responsible for <br />the amount within the Self-Insured <br />Retention For Contractors Indemnity For <br />Subcontractor's Pollution Liability <br />Coverage for all "loss" under Contractors <br />Indemnity For Subcontractor's Pollution <br />Liability Coverage arising out of the <br />same or "related" "pollution conditions". <br />4. If you are unable to be financially <br />responsible for "loss" within the Self- <br />Insured Retention For Contractors <br />Indemnity For Subcontractor's Pollution <br />Liability Coverage because of: <br />a. Your insolvency or bankruptcy; or <br />b. Any other reason; <br />Contractors Indemnity For Subcontractor's <br />Pollution Liability Coverage will only <br />apply to amounts that are in excess of <br />the Self-Insured Retention For Contractors <br />Indemnity For Subcontractor's Pollution <br />Liability Coverage. <br />SECTION VIII - CONDITIONS <br />The following conditions apply to all of <br />"your ECP coverage forms" and are in <br />addition to the conditions contained in each <br />such coverage form. <br />1. Bankruptcy <br />Bankruptcy or insolvency of: <br />a. The "insured" or of the "insured's" <br />estate; <br />b. The "design professional" under any <br />Contractors Indemnity For Design <br />Professional's Liability Coverage; or <br />c. The "specified subcontractor" under <br />any Contractors Indemnity For <br />Subcontractor's Pollution Liability <br />Coverage; <br />will not relieve us of our obligations <br />under this policy. However, this provision <br />does not delete or amend any Bankruptcy <br />Or Insolvency exclusion in this policy. <br />2. Cancellation <br />a. The "First Named Insured" may cancel <br />this policy by mailing or delivering in <br />advance to us written notice of <br />cancellation stating the effective date <br />of the cancellation. <br />b. We may cancel this policy by mailing <br />or delivering to the "First Named <br />Insured" written notice of cancellation <br />at least: <br />(1) 10 days before the effective date <br />of cancellation if the cancellation <br />is for nonpayment of premium; or <br />(2) 30 days before the effective date <br />of cancellation if the cancellation <br />is for any other reason. <br />c. We will mail or deliver its notice of <br />cancellation to the "First Named <br />Insured's" last mailing address known <br />to us. <br />d. Our notice of cancellation will state <br />the effective date of the cancellation, <br />which will become the end of the <br />"policy period". <br />e. If this policy is cancelled, we will <br />send the "First Named Insured" any <br />premium refund due. If we cancel this <br />policy, the refund will be pro rata. If <br />the "First Named Insured" cancels this <br />policy, the refund may be less than <br />pro rata. The refund will be made by <br />us as soon as practicable. However, <br />the cancellation will be effective even <br />if we have not made or offered the <br />refund. <br />f. If notice of cancellation is mailed, <br />proof of mailing will be sufficient <br />proof of notice. <br />3. Changes <br />This policy contains all the agreements <br />between you and us concerning the <br />insurance afforded. Only the "First <br />Named Insured" may request changes to <br />this policy. This policy can be amended <br />only with our consent and only by <br />endorsement issued by us as part of this <br />policy. <br />4. Examination Of Books And Records <br />We may examine and audit your books <br />and records that relate to the subject <br />matter of this insurance at any time: <br />a. During the "policy period"; or <br />b. Up to three years after the end of the <br />"policy period". <br />5. Inspections And Surveys <br />a.
