POLLUTION AND CONTRACTORS PROFESSIONAL LIABILITY <br /> <br /> <br /> <br />RP 10 00 10 21 ª 2021 The Travelers Indemnity Company. All rights reserved. Page 7 of 37 <br /> <br /> <br /> <br />Limits Of Insurance That Apply To Certain <br />Losses If Any Otherwise Applicable Limit Of <br />Insurance Has Been Increased <br />If the amount shown for any of the <br />Limits of Insurance in the Travelers ECP <br />Custom Declarations: <br />a. Is an increase from the amount <br />shown for that or an equivalent limit <br />of insurance in the Declarations of <br />any prior insurance policy issued by <br />us, or any of our affiliated insurance <br />companies, to any "named insured"; <br />or <br />b. Is increased during the "policy <br />period"; <br />the higher amount shown for that limit <br />of insurance in the Travelers ECP <br />Custom Declarations does not apply to <br />any of the following that are subject to <br />that limit: <br />a. "Loss" and "defense expenses" under <br />any "Pollution Liability Coverage", <br />"loss" under any Crisis Management <br />Services Expenses For Pollution <br />Liability Coverage or "loss" under any <br />Contractors Indemnity For Sub- <br />contractor's Pollution Liability Coverage, <br />arising out of: <br />(1) "Pollution conditions"; or <br />(2) Any "pollution conditions" in <br />"related" "pollution conditions"; <br />if any of the "pollution conditions" in <br />Paragraph (1) or (2) above commenced <br />before such increase; <br />b. "Loss" and "defense expenses" under <br />any Contractors Professional Liability <br />Coverage arising out of any act, error <br />or omission that was committed <br />before such increase; or <br />c. "Loss" under: <br />(1) Any Contractors Professional <br />Liability Loss Mitigation Expenses <br />Coverage; or <br />(2) Any Contractors Indemnity For <br />Design Professional's Liability <br />Coverage; <br />arising out of any act, error or <br />omission that was committed before <br />such increase. <br />Instead, the amount of that limit of <br />insurance that applies to such "loss" and <br />"defense expenses" is the lower amount <br />shown for that or an equivalent limit of <br />insurance in the Declarations of such <br />prior insurance policy, or shown for that <br />limit of insurance in the Travelers ECP <br />Custom Declarations, that was in effect <br />when any of the "pollution conditions" <br />that caused such "loss" commenced or <br />when the act, error or omission that <br />caused such "loss" was committed. <br />Each act, error or omission in a series <br />of "related" acts, errors or omissions <br />will be deemed to have been committed <br />on the date the first act, error or <br />omission in that series is committed. <br />2. The Aggregate Limit is the most we will <br />pay for the sum of all: <br />a. "Loss", other than "crisis management <br />services expenses", and "defense <br />expenses"; and <br />b. "Loss" that is "crisis management <br />services expenses" if the amount <br />shown for the Crisis Management <br />Services Expenses For Pollution <br />Liability Aggregate Limit in the <br />Travelers ECP Custom Declarations is <br />more than $250,000; <br />to which the insurance provided under <br />one or more of "your ECP coverage <br />forms" applies for the combined total of <br />all "claims", "emergency response <br />costs", "on-site pollution clean-up costs", <br />"defense expenses", "professional <br />liability loss mitigation expenses", <br />"pollution loss mitigation expenses", <br />"business interruption loss" and such <br />"crisis management services expenses". <br />3. Subject to Paragraph 2. above, the <br />Emergency Response Costs Aggregate <br />Limit is the most we will pay for the <br />sum of all "loss" that is "emergency <br />response costs", and "defense expenses": <br />a. Under Emergency Response Costs in <br />any Contractors Pollution Liability <br />Coverage; and <br />b. Under Asbestos Emergency Response <br />Costs in any Contractors Asbestos <br />Pollution Liability Coverage; <br />for the combined total of all such "loss" <br />and "defense expenses". <br />4. Subject to Paragraph 2. above, the On- <br />Site Pollution Clean-Up Costs Aggregate <br />Limit is the most we will pay for the <br />sum of all: <br />a. "Loss" that is "on-site pollution <br />clean-up costs", and "defense <br />expenses", under On-Site Pollution <br />Clean-Up Costs; and <br />b.
