RP 10 00 10 21 <br /> <br /> <br /> <br />only because of the expiration of <br />such insurance. <br />For the purposes of any Contractors <br />Pollution Liability Coverage, any <br />Contractors Asbestos Pollution <br />Liability Coverage and any Non-Owned <br />Disposal Site Pollution Legal Liability <br />Coverage, this exclusion does not <br />apply to any "named insured's" <br />liability for "loss" arising out of the <br />performance of "covered operations" <br />in the conduct of the business of <br />such current or past partnership, joint <br />venture or limited liability company if <br />such "named insured" would have <br />been covered for the "loss" by other <br />pollution liability insurance issued to <br />such partnership, joint venture or <br />limited liability company but is not <br />only because of the expiration of <br />such insurance. <br />j. War <br />"Loss" arising out of: <br />(1) War, including undeclared or civil <br />war; <br />(2) Warlike action by a military force, <br />including action in hindering or <br />defending against an actual or <br />expected attack, by any <br />government, sovereign or other <br />authority using military personnel <br />or other agents; or <br />(3) Insurrection, rebellion, revolution, <br />usurped power, or action taken by <br />governmental authority in hindering <br />or defending against any of these. <br />k. Workers Compensation Or Other Benefits <br />Laws <br />Any obligation that the "insured" has <br />under any: <br />(1) Workers compensation law; <br />(2) Disability benefits law; <br />(3) Unemployment compensation law; <br />or <br />(4) Similar law. <br />3. Right To Appeal A Judgment <br />We will have the right to appeal a <br />judgment that: <br />a. Includes "loss" to which this <br />insurance applies; <br />b. Is awarded in a "claim" for which we <br />defend an "insured"; and <br />c. Is awarded against the "insured". <br />If we appeal a judgment that we do not <br />have a duty to appeal, we will pay all of <br />the following that result directly from <br />that appeal: <br />a. All expenses we incur; and <br />b. All reasonable expenses, other than <br />the cost of any required appeal bond, <br />incurred at our request by the <br />"insured" to assist us with the <br />appeal, including, only if the "insured" <br />is an individual, actual loss of <br />earnings up to $500 a day by that <br />individual because of time taken off <br />from work. <br />These payments will not reduce the <br />limits of insurance. The results of an <br />appeal will not change the applicable <br />limit of insurance. <br />Our duty to make such payments ends <br />when we have used up the applicable <br />limit of insurance in the payment of <br />"loss" or "defense expenses", including <br />any combination of such payments. <br />SECTION II - LIMITS OF INSURANCE <br />1. The Limits of Insurance shown in the <br />Travelers ECP Custom Declarations and <br />the rules below fix the most we will pay <br />regardless of the number of: <br />a. "Insureds"; <br />b. "Claims" made; <br />c. Persons or organizations making <br />"claims"; <br />d. "Design professionals" under any <br />Contractors Indemnity For Design <br />Professional's Liability Coverage; <br />e. "Specified subcontractors" under any <br />Contractors Indemnity For Sub- <br />contractor's Pollution Liability Coverage; <br />f. "Emergency response costs" losses <br />incurred under any Contractors <br />Pollution Liability Coverage and any <br />Contractors Asbestos Pollution <br />Liability Coverage; <br />g. "Covered operations" under any <br />Contractors Pollution Liability <br />Coverage, any Non-Owned Disposal <br />Site Pollution Legal Liability Coverage, <br />any Contractors Asbestos Pollution <br />Liability Coverage and any Contractors <br />Indemnity For Subcontractor's <br />Pollution Liability Coverage; <br />h. "On-site pollution clean-up costs" <br />losses incurred under any Site <br />Pollution Liability Coverage; or <br />i.
