POLLUTION AND CONTRACTORS PROFESSIONAL LIABILITY <br /> <br /> <br /> <br />RP 10 00 10 21 ª 2021 The Travelers Indemnity Company. All rights reserved. Page 3 of 37 <br /> <br /> <br /> <br />(2) Any organization that any <br />"insured": <br />(a) Owns more than a 25% interest <br />in; or <br />(b) In whole or substantially: <br />(i) Controls financially; or <br />(ii) Manages or operates; <br />(3) Any organization, other than a <br />partnership, joint venture or <br />limited liability company, that has <br />a director or "executive officer" <br />who: <br />(a) Owns more than a 25% interest <br />in any "named insured"; or <br />(b) In whole or substantially: <br />(i) Controls financially; or <br />(ii) Manages or operates; <br />any "named insured"; <br />(4) Any organization that is a <br />partnership, joint venture or <br />limited liability company and that <br />has a partner or member who: <br />(a) Owns more than a 25% interest <br />in any "named insured"; or <br />(b) In whole or substantially: <br />(i) Controls financially; or <br />(ii) Manages or operates; <br />any "named insured"; or <br />(5) Any person who is: <br />(a) An "employee", director, <br />"executive officer", partner or <br />member of any organization <br />described in Paragraph (2), (3) <br />or (4) above; or <br />(b) The spouse, child, parent, <br />brother or sister of an <br />"employee", director, "executive <br />officer", partner or member of <br />any organization described in <br />Paragraph (2), (3) or (4) above if <br />the "claim" is made as a <br />consequence of "loss", injury <br />or damage sustained by that <br />"employee", director, "executive <br />officer", partner or member. <br />This exclusion does not apply if the <br />"claim" is made for any obligation to <br />share "loss" with, or repay someone <br />else who must pay "loss", as a <br />consequence of "loss", injury or <br />damage sustained by a person or <br />organization other than an "insured", <br />an organization described in Paragraph <br />(2), (3) or (4) above or a person <br />described in Paragraph (5) above. <br />For the purposes of any Contractors <br />Pollution Liability Coverage, any <br />Contractors Asbestos Pollution <br />Liability Coverage and any Non-Owned <br />Disposal Site Pollution Legal Liability <br />Coverage, Paragraph (1) of this <br />exclusion does not apply to any <br />"claim" for "loss" that is made by or <br />on behalf of any person or <br />organization that is an "insured" under <br />Paragraph e. of the definition of <br />"insured". <br />For the purposes of any Contractors <br />Indemnity For Design Professional's <br />Liability Coverage and any Contractors <br />Indemnity For Subcontractor's Pollution <br />Liability Coverage, Paragraphs (2), (3) <br />and (4) of this exclusion do not apply. <br />c. Contract Liability <br />"Loss" for which the "insured" has <br />assumed liability under any contract <br />or agreement. <br />This exclusion does not apply to <br />"loss" for which the "insured" would <br />have liability without the contract or <br />agreement. <br />For the purposes of any Contractors <br />Professional Liability Coverage, this <br />exclusion does not apply to the "tort <br />liability" of another to pay "loss" <br />that is sustained by others if you <br />have assumed such liability under an <br />"insured contract", but only if the <br />"loss" is caused by an act, error or <br />omission or that: <br />(1) Results from the performance of, <br />or failure to perform, "your <br />contractor professional services" <br />by you or on your behalf; and <br />(2) Was committed subsequent to the <br />execution of the "insured <br />contract". <br />For the purposes of any Contractors <br />Pollution Liability Coverage, any <br />Contractors Asbestos Pollution <br />Liability Coverage and any Non-Owned <br />Disposal Site Pollution Legal Liability <br />Coverage, this exclusion does not <br />apply to the "tort liability" of another <br />to pay "loss" that is sustained or <br />incurred by others if you have <br />assumed such liability under an <br />"insured contract", but only if the <br />"loss": <br />(1) Results from "pollution conditions" <br />that: <br />DocuSign Envelope ID: E0C7DD5C-4FA6-4C9E-85B9-3CA337445269
