Force Majeure: Williams Scotsman shall not be responsible for any delays which may <br />arise beyond Williams Scotsman's control, including without limitation, delays caused <br />by County, their employees, agents or other contractor's, or any third parties; <br />governmental and/or municipal authorities; acts of God; stormy or inclement weather; <br />union activities and/or other labor issues; floods, fire, earthquakes, windstorms or other <br />catastrophe; manufacturer's delays; loss or damage to units during transport; <br />transportation delays; shortages of materials; delays in obtaining permits, licenses, <br />approvals, tests or inspections; archaeological/paleontological discoveries; hazardous <br />materials encountered at Site; conditions existing at Site; or any other conditions beyond <br />Williams Scotsman's control. Provider shall not be responsible for delays beyond its <br />control. <br /> <br />u. PROVIDER SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY <br />CONSEQUENTIAL, INCIDENTAL, PUNITIVE, LIQUIDATED, OR SPECIAL <br />DAMAGES, COSTS, OR EXPENSES ARISING IN RELATION TO THE <br />AGREEMENT BETWEEN THE PARTIES, THE EQUIPMENT, THE WORK, OR <br />ANY OTHER CAUSE OR FACTOR. <br /> <br /> <br /> <br /> <br />v. Signatures. This Agreement together with any amendments or modifications may be <br />executed electronically. All electronic signatures affixed hereto evidence the consent of <br />the Parties to utilize electronic signatures and the intent of the Parties to comply with <br />Article 11A and Article 40 of North Carolina General Statute Chapter 66. <br /> <br />w.
