6 <br /> Relevant Statutes <br /> § 20-174.2. Local ordinances; pedestrians gathering, picketing,or protesting on roads or <br /> highways. <br /> (a)A municipality or a county may adopt an ordinance regulating the time, place, and manner of <br /> gatherings, picket lines, or protests by pedestrians that occur on State roadways and State highways. <br /> (b) Nothing in this section shall permit a municipality or a county to impose restrictions or prohibitions <br /> on the activities of any of the following persons who are engaged in construction or maintenance, or in <br /> making traffic or engineering surveys: <br /> (1) Licensees, employees, or contractors of the Department of Transportation. <br /> (2) Licensees, employees, or contractors of a municipality. <br /> § 153A-121. General ordinance-making power. <br /> (a)A county may by ordinance define, regulate, prohibit, or abate acts, omissions, or conditions <br /> detrimental to the health, safety, or welfare of its citizens and the peace and dignity of the county; and <br /> may define and abate nuisances. <br /> (b)This section does not authorize a county to regulate or control vehicular or pedestrian traffic on a <br /> street or highway under the control of the Board of Transportation, nor to regulate or control any right- <br /> of-way or right-of-passage belonging to a public utility, electric or telephone membership corporation, <br /> or public agency of the State. In addition, no county ordinance may regulate or control a highway right- <br /> of-way in a manner inconsistent with State law or an ordinance of the Board of Transportation. <br /> (c)This section does not impair the authority of local boards of health to adopt rules and regulations to <br /> protect and promote public health. <br /> § 153A-129. Firearms. <br /> (c)A county may regulate the display of firearms on the public roads, sidewalks, alleys, or other public <br /> property <br /> 14-277.2.Weapons at parades,etc., prohibited. <br /> (a) It shall be unlawful for any person participating in, affiliated with, or present as a spectator at any <br /> parade, funeral procession, picket line, or demonstration upon any private health care facility or upon <br /> any public place owned or under the control of the State or any of its political subdivisions to willfully or <br /> intentionally possess or have immediate access to any dangerous weapon. Violation of this subsection <br /> shall be a Class 1 misdemeanor. It shall be presumed that any rifle or gun carried on a rack in a pickup <br /> truck at a holiday parade or in a funeral procession does not violate the terms of this act. <br /> (b) For the purposes of this section the term "dangerous weapon" shall include those weapons specified <br /> in G.S. 14-269, 14-269.2, 14-284.1, or 14-288.8 or any other object capable of inflicting serious bodily <br /> injury or death when used as a weapon. <br /> (c)The provisions of this section shall not apply to a person exempted by the provisions of G.S. 14- <br /> 269(b) or to persons authorized by State or federal law to carry dangerous weapons in the performance <br />
