Davis, AICP <br />Current Planning Supervisor <br />DATE: Tuesday, May 03, 2005 <br />RE: REVIEW of State Legislation to establish and L^nvironmental Recovery Fee for <br />Mobile Homes <br />Please be advised that the State Legislature is currently reviewing a bill that would establish a <br />fund to assist counties with the cost of removing old, dilapidated mobile homes. This <br />memorandum provides an analysis of the proposed legislation and what impact, if any, will be <br />felt in Orange County. <br />BACKGROUND: <br />The Senate Bill, specifically Senate Bill 91.3, was sponsored by Senator Dan Clodfelter of <br />Mecldenburg Comity and co-sponsored by Senator Stan Binghani, of Davidson and Guilford <br />Comities, and John I{err III, of Pitt, Wayne, and Greene Counties. The Bill was filled in March of <br />2005 and referred to the Judiciary Committee for review and comment. A similar Bill has been <br />submitted in the House for review, specifically House Bill 1288, <br />The Bill, as currently written, would establish a manufactured home disposal tax of $300 for each new <br />or used single-wide manufactured home, and for each section of each new or used multi-section <br />manufachued home, applicable to sales that occur on or alter .Tan, 1, 2006. It is important to note that <br />the proposed manufactured home disposal tax does not include a fee on the lease or rental of mobile <br />homes within the State.
