Article 6: Development Standards 97 <br /> Section 6.14: Stormwater Management <br /> (4) A person is considered to be in violation of this Ordinance if the person connects <br /> a line conveying sewage to the stormwater collection system, or allows such a <br /> collection to continue. <br /> (5) Grace Periods <br /> (a) Where such connections exist in violation of this Ordinance, the property <br /> owner, or person using said connection shall be required to remove the <br /> connection within one year following the notice of violation. This grace <br /> period shall not apply to connections which may result in the discharge of <br /> hazardous materials or other discharges which pose an immediate threat <br /> to health and safety, or are likely to result in immediate injury and harm <br /> to human, animal or plant life, and natural resources. <br /> (b) Where it is determined that the one year grace period shall not apply, the <br /> Erosion Control Officer shall determine the time within which the <br /> connection shall be removed. In setting the time limit for compliance, the <br /> Erosion Control Officer shall take into consideration the following: <br /> (i) The quantity and complexity of the work. <br /> (ii) The consequences of delay. <br /> (iii) The potential harm to the environment, to the public health, to <br /> public and private property, to wildlife, and to natural resources. <br /> (iv) The cost of remedying the damage. <br /> (F) Spills <br /> (1) Spills or leaks of polluting substances discharged to, or having the potential to <br /> reach the stormwater collection system or receiving waters, shall be contained, <br /> controlled, collected, and removed promptly. All affected areas shall be restored <br /> to their preexisting condition. <br /> (2) Notification of Spills <br /> (a) Notwithstanding other requirements of law, as soon as any person <br /> responsible for a facility or operation, or responsible for emergency <br /> response for a facility or operation (the Financially Responsible <br /> � P-ersenParty243) has information of any known or suspected release of <br /> materials which are resulting or may result in illegal discharges or <br /> pollutants discharging into or may reach the stormwater collection <br /> system or waters of Orange County, the Financially Responsible Pensen <br /> Party shall take all necessary steps to ensure the discovery, <br /> containment, and cleanup of such discharge. <br /> (b) In the event of such a discharge of hazardous materials, the Financially <br /> Responsible Pe�Party shall immediately notify emergency response <br /> agencies of the occurrence via emergency dispatch services, and shall <br /> notify the Erosion Control Officer within 24 hours. <br /> (c) In the event of a discharge of non- hazardous materials, the Financially <br /> Responsible P-ersor-Party shall notify the Erosion Control Officer no later <br /> than the next business day. <br /> (d) All notifications shall be confirmed by written notice addressed and <br /> mailed to the-Orange244 County within three business days of the <br /> discharge. <br /> z43 Consistent use of"Financially Responsible Party'so as to match the Definitions section of this Ordinance— <br /> NOTE: "Financially Responsible Party"is integrated through the remainder of Section 6.14, where applicable. <br /> 144 Consistent reference to"Orange County". <br /> Orange County, North Carolina—Unified Development Ordinance Page 6-114 <br />
