38 <br /> (B) A detailed explanation describing the differences in the three boundary lines contained in <br /> (A) above. <br /> 2.26.7 Flood Regulations <br /> (A) Any property owner who has received an order to take corrective action in accordance <br /> with Section 9.7 may appeal the order to the local elected governing body by giving <br /> notice of appeal in writing to the Floodplain Administrator and the clerk within ten <br /> business days following issuance of the final order. <br /> (B) The local governing body shall hear an appeal within a reasonable time and may affirm, <br /> modify and affirm, or revoke the order. <br /> 2.26.8 Soi-Erosion and Sedimentation Control Plan" <br /> (A) Appeal of Erosion and Sedimentation Control Plan <br /> Except as provided in subsection (D) below, the appeal of a disapproval or an;approval <br /> with modifications, or approval with conditions of an Erosion Erosion and Sedimentation <br /> Control Plan shall be governed by the following provisions: <br /> (1) The disapproval or modification of , <br /> attaadto any proposed EFGSi9RrErosion and Sedimentation Control Plan by <br /> the Erosion Control Officer shall entitle the person submitting the plan to an <br /> appeal of the decision to the Orange County Planning Director. <br /> (2) If the Planning Director upholds the decision, the person shall be entitled to a <br /> public hearing if such person submits written demand for a hearing within 15 <br /> days after receipt of written notice of disapproval, modification, or conditions of <br /> approval. <br /> (B) Hearings <br /> (1) Orange County <br /> (a) This sub-subsection pertains to appeals for Lland-Ddisturbing Aactivities <br /> occurring outside the corporate limits of the Towns of Chapel Hill, <br /> Carrboro, and Hillsborough, and the City of Mebane. <br /> (b) Hearings held pursuant to this sub-subsection shall be conducted by the <br /> Orange County Planning Board within 30 days after receipt of written <br /> demand, as provided for in (A)(2) above. <br /> (c) The Orange County Planning Board shall make recommendations to the <br /> Board of County Commissioners within 30 days after the date of the <br /> hearing on such Erosion .Erosion and Sedimentation Control Plan. <br /> (d) The Board of County Commissioners will render its final decision on any <br /> Erosion Erosion and Sedimentation Control Plan appeal within 30 days <br /> of receipt of the Planning Board recommendation. <br /> (2) Other than Orange County <br /> (a) This sub-subsection pertains to appeals for Lland-Ddisturbing Aactivities <br /> occurring within the corporate limits of the Towns of Chapel Hill, <br /> Carrboro, and Hillsborough, and the City of Mebane. <br /> 81 Consistent use of"Erosion and Sedimentation Control Plan"as defined in 15A NCAC 02H.1002 (Definitions)— <br /> NOTE: "Erosion and Sedimentation Control Plan"is integrated through the remainder of Section 2.26, where <br /> applicable. <br /> Orange County, North Carolina—Unified Development Ordinance Page 3-Ixxviii <br />
