<br /> <br />13 <br />Revised 9/8/2021 <br />Standard Terms and Conditions. To satisfy these requirements, Recipient must maintain an <br />active registration in the System for Award Management (SAM) database. Please consult the <br />SAM website (https://www.sam.gov/SAM/) for more information. <br /> <br />20. Trafficking in Persons. This award is subject to the requirements of Section 106 (g) of the <br />Trafficking Victims Protection Act of 2000, as amended (22 U.S.C. 7104). For the full text of <br />the award term, refer to Attachment B to these Standard Terms and Conditions. <br /> <br />21. Subaward Reporting and Executive Compensation. This award is subject to the reporting <br />requirements of the Federal Funding Accountability and Transparency Act of 2006 (P ublic <br />Law 109-282), as amended by Section 6202 of Public Law 110-252 and implemented by 2 <br />CFR Part 170. Recipients must report information for each first-tier subaward of $25,000 or <br />more in Federal funds and executive total compensation for the Recipient’s and Subrecipients’ <br />five most highly compensated executives as outlined in Appendix A to 2 CFR Part 170. <br />Information about the Federal Funding Accountability and Transparency Act Subawar d <br />Reporting System (FSRS) is available at www.fsrs.gov. For the full text of the award term, <br />refer to Attachment C to these Standard Terms and Conditions. <br /> <br />22. Employee Whistleblower Protections. All Recipients must inform their employees in <br />writing of employee whistleblower rights and protections under 41 U.S.C. 4712 in the <br />predominant native language of the workforce. For the full text of the award term, re Pilot <br />Program for Enhancement of Contractor Employee Whistleblower Protections, refer to <br />Attachment D to these Standard Terms and Conditions. <br /> <br />23. Conflict of Interest Policies. In accordance with 45 CFR §75.112, these terms and conditions <br />establish the conflict of interest policy requirements for recipients receiving federal <br />discretionary grant funding from CMS. Recipient must comply with the conflict of interest <br />policy requirements outlined in Attachment E to these Standard Terms and Conditions. <br /> <br />24. Recipient Integrity and Performance. In accordance with Appendix XII to 45 CFR part 75, <br />Recipient must comply with reporting requirements for matters relate d to recipient integrity <br />and performance. For the full text of the award term, refer to Attachment F to these terms <br />and conditions. <br /> <br />25. Accessibility Provisions. You must administer your project in compliance with federal civil <br />rights laws that prohibit discrimination on the basis of race, color, national origin, disability, age <br />and, in some circumstances , religion, conscience, and sex (including gender identity, sexual <br />orientation, and pregnancy). This includes taking reasonable steps to provide meaningful access <br />to persons with limited English proficiency and providing programs that are acces sible to and <br />usable by persons with disabilities. The HHS Office for Civil Rights provides guidance on <br />complying with civil rights laws enforced by HHS. See https://www.hhs.gov/civil-rights/for- <br />providers/provider-obligations/index.html and https://www.hhs.gov/civil-rights/for- <br />individuals/nondiscrimination/index.html. <br /> <br />• You must take reasonable steps to ensure that your project provides meaningful <br />access to persons with limited English proficiency.
