Failure to comply with CMS’s and any of its contractors ’ efforts to monitor the InCK <br />Model including failure to submit to CMS and/or its contractors complete and accurate <br />data required for monitoring , as outlined in Section 14 of this document (Monitoring). <br />H. Failure to comply with CMS’s and any of its contractors’ efforts to evaluate the InCK <br />Model including failure to submit to CMS and/or its contractors complete a nd accurate <br />data required for evaluation purposes , as outlined in Section 18 of this document <br />(Evaluation). <br />I. Inability or unwillingness to collect or share monitoring or evaluation data. <br />J. Failure to participate in Learning System activities as required throughout the duration <br />of the project period. <br />K. Failure to undertake and implement technical assistance provided by CMS or its <br />contractors. <br />L. Failure to submit timely, complete and accurate reports as required including, QPRs, <br />APRs, Quarterly Federal Cash Transaction Reports, Annual Fina ncial Expenditure <br />Reports, Final Expenditure and Progress Reports; and other documentation upon <br />request, such as a sample service integration eligibility checklist and needs assessment <br />tool. See NOFO section A 4.2.1.2.2 for requirements related to the needs assessment <br />tool. <br />M. A documented pattern of non-cooperation with CMS, its contractors, HHS or other <br />federal agencies, including without limitation, not being available to CMS, or its <br />contractors, HHS or other federal agencies. <br />N. Using Cooperative Agreement funds in a manner that does not comply with Section 24 <br />of this document (Use of Funds ). <br />O. Failure to report and mitigate program duplication as described in NOFO Section <br />A4.2.3. <br /> <br />26. Notification of risk or problems: The Recipient shall notify the PO and Grants <br />Management Specialist in writing of any significant problems or risks re lating to the <br />administrative, financial, and programmatic aspects of the award during the Cooperative <br />Agreement period of performance immediately following t he time of discover y. Significant <br />problems include but are not limited to adverse findings pursuant to section 38 of the <br />Standard Terms and Conditions (Affirmative Duty to Track All Parties to the Award), or <br />issues or barriers that may cause the Recipient to miss model miles tones described in either <br />the Implementation Plan, Operational Plan, or the Terms and Conditions of Award, or <br />failure to implement the InCK Model as described in the Notice of Award. <br />CMS may elect, at its sole discretion, to allow the Recipient an opportunity to take <br />appropriate corrective action that may includ e accepting special award conditions, technical <br />assistance, adhering to a program assistance letter or corrective action plan within a <br />timeframe and manner determined by CMS, or for CMS to take other enforcement actions, <br />unless there are actions that endanger the public health and welfare.
