BID PROPOSAL SECURITY <br /> A Bid Bond is required in the amount of 5% of the Bid Proposal. Bidder shall use the Bid <br /> Bond Form located in Section 004000. <br /> 6. RECEIPT OF BID PROPOSALS <br /> Bid Proposals shall be received in strict accordance with requirements of the North Carolina <br /> General Statutes. Prior to the announced Closing Time for Bids, the Bidder will be pennitted to <br /> change or withdraw hisiher Bid Proposal as allowed by Item I.H. of these Instructions to Bidders. <br /> All copies of the Bid Proposal, if any,and any other documents required to be submitted with <br /> the Bid Proposal shall be combined.'merged into a single electronic document (PDF format). The <br /> single electronic Bid Proposal document (PDF fonnat) shall be e-mailed to <br /> jatnaroCa;orangecountync.go by the announced Closing Time for Bids. The electronic Bid Proposal <br /> document shall be marked"Bid Proposal"and bearing the name of Project,name and address of the <br /> Bidder,the Bidder's license number and,if applicable,the designated portion of the Work for which <br /> the Bid Proposal is submitted. <br /> 7. OPENING OF BID PROPOSALS <br /> There will not be a formal bid opening. Results will be made available after award. <br /> A Bidder may withdraw their Bid Proposal after the announced Closing Time for Bids <br /> without forfeiting their Bid Proposal deposit in certain limited circumstances. Withdrawal after the <br /> announced Closing Time for Bids is pennitted only if all of the following conditions specified in <br /> North Carolina General Statutes §143-129.1 are met: <br /> A. The Bid Proposal was submitted in good faith. <br /> B. The Bid Proposal price "was based upon a mistake,which constituted a substantial <br /> error". <br /> C. Credible evidence is submitted showing that the error (1) was clerical nature as <br /> opposed to a judgment error, and (2) was actually due to an unintentional and <br /> substantial arithmetic error or an unintentional omission of a substantial quantity of <br /> work, labor, material or services made directly in the compilation of the Bid <br /> Proposal. <br /> D. The error can be clearly shown by objective evidence drawn from inspection of the <br /> original work papers, documents or materials used in the preparation of the Bid <br /> Proposal, <br /> E. The request to withdraw(1)the Bid Proposal is made in writing to the public agency <br /> that invited the Bid Proposals,and(2)is made prior to the award of the Contract,but <br /> not later than seventy-two (72) hours after the announced Closing Time for Bids. <br /> Instructions to Bidders 003000-4 <br />
