The undersigned declared the existence of a state of emergency in Orange County <br /> pursuant to North Carolina General Statute 166A-22 on March 13, 2020 ("Original Declaration") <br /> and revised the Original Declaration on March 25, 2020, April 23, 2020, May 6, 2020, May 21, <br /> 2020,June 10, 2020, June 26, 2020, July 9, 2020,July 17, 2020, and August 18, 2020. <br /> Sec. 2. The Governor of North Carolina, through Executive Order 163 ("EO 163"), moved North <br /> Carolina into "Safer-At-Home" Phase 2.5. <br /> Sec. 3. The undersigned has previously adopted revised declarations of emergency <br /> incorporating the terms of various gubernatorial Executive Orders with some changes deemed <br /> necessary and specific to Orange County. <br /> Sec. 4. In consideration of all available data related to the impacts of COVID-19 in Orange <br /> County the undersigned, in consultation with the Orange County Health Director, determines it <br /> is in the best interest of the residents of Orange County to repeal the prior amendments to the <br /> Original Declaration, specifically adopts the findings and conclusions of EO 163 and adopts and <br /> fully incorporates the terms, including all limitations and restrictions, of EO 163 to be effective <br /> in Orange County unless and until modified by the Chair of the Board of County Commissioners <br /> with the following exceptions: <br /> a. The declared State of Emergency in Orange County extends through and including October <br /> 31, 2020; <br /> b. The Prohibition on Mass Gatherings found in Section 7.1.a. of EO 163 is modified for <br /> Orange county and shall remain at 10 people indoors and 25 people outdoors; <br /> Sec. S. Pursuant to the authority granted by Chapter 14 of the Orange County Code of General <br /> Ordinances and Chapter 166A of the North Carolina General Statutes, all prohibitions and <br /> restrictions specified in the July 9t" and July 17t" Amendments to the Declarations remain in full <br /> force and effect during the ongoing state of emergency unless and until amended and <br /> government bodies when conducting meetings should continue to do so remotely.
