The undersigned declared the existence of a state of emergency in Orange County <br /> pursuant to North Carolina General Statute ("NCGS") 166A-22 on March 13, 2020 and revised <br /> said declaration of emergency on March 25, 2020, April 23, 2020, May 6, 2020, May 21, 2020, <br /> June 10, 2020, and June 26, 2020 (the "Declarations"). <br /> Sec. 2. The Governor of North Carolina, through Executive Order 138 ("EO 138), began moving <br /> the state into Phase 1 of the state's planned COVID-19 recovery on May 8, 2020; through <br /> Executive Order 141 ("EO 141") began moving the state into Phase 2 on May 22, 2020; and <br /> through Executive Order 147 ("EO 147") mandated the wearing of face coverings throughout <br /> North Carolina. <br /> Sec. 3. The undersigned adopted a revised declaration of emergency incorporating the terms <br /> of EO 141, with minimal changes, having an effective date of May 22, 2020 and amended that <br /> declaration on June 10, 2020 to extend the effective date of the Declarations through August <br /> 31, 2020 and to require face coverings in Orange County and adopted EO 147 on June 26, 2020 <br /> while maintaining several Orange County specific restrictions. The undersigned has determined <br /> that further restrictions are necessary to help slow the spread of COVID-19 and makes the <br /> following Findings in support thereof: <br /> i. North Carolina entered Phase 1 of reopening on May 81"; and <br /> ii. Since Orange County entered Phase 1 of reopening the number of cases in <br /> the County has surged from 273 on May 81" to 850 on July 81"; and <br /> iii. EO 141 allowed restaurants to reopen with limited capacity and specific rules <br /> applicable thereto; and <br /> iv.
