The undersigned declared the existence of a state of emergency in Orange County <br /> pursuant to North Carolina General Statute 166A-22 on March 13, 2020 ("Original Declaration") <br /> and revised the Original Declaration on March 25, 2020, April 23, 2020, May 6, 2020, May 21, <br /> 2020,June 10, 2020, June 26, 2020, July 9, 2020,July 17, 2020, August 18, 2020, and September <br /> 4, 2020. <br /> Sec. 2. On September 30, 2020 the Governor of North Carolina announced Executive Order 169 <br /> ("EO 169") moving North Carolina into Phase 3 of reopening. <br /> Sec. 3. The undersigned has previously adopted revised declarations of emergency <br /> incorporating the terms of various gubernatorial Executive Orders with some changes deemed <br /> necessary and specific to Orange County. <br /> Sec. 4. In consideration of all available data related to the impacts of COVID-19 in Orange <br /> County the undersigned, in consultation with the Orange County Health Director, hereby <br /> determines it is in the best interest of the residents of Orange County to repeal the prior <br /> amendments to the Original Declaration and amend the Original Declaration by adopting the <br /> findings and conclusions of EO 169 and adopts and fully incorporates the terms, including all <br /> limitations and restrictions, of EO 169 to be effective in Orange County with the following <br /> exceptions: <br /> a. The declared State of Emergency in Orange County is amended as stated herein and <br /> extends through and including December 31, 2020; <br /> Sec. S. Pursuant to the authority granted by Chapter 14 of the Orange County Code of General <br /> Ordinances and Chapter 166A of the North Carolina General Statutes the terms and conditions <br /> of EO 169 shall remain in effect in Orange County, regardless of any action taken by the <br /> Governor, unless and until modified or repealed by the Chair of the Board of County <br /> Commissioners. Government bodies when conducting meetings should continue to do so <br /> remotely.
