Reschedule activities to achieve maximum practical concurrence of <br />accomplishment of activities, and comply with the revised schedule. <br /> <br />4. Costs incurred by the Owner arising from such lengthening of hours, <br />LQFOXGLQJIXUQLVKLQJRI,QVSHFWRUVVKDOOEH <br />and shall be deducted from monies due him. Failure of the Contractor to <br />comply with these requirements may be grounds for determination by the <br />Engineer that the Contractor is not proceeding at such rates as will insure <br />completion within the specified time and may result in the termination of <br />the right of the Contractor to continue the work. <br /> <br />30.8 Adjustment of Contract Schedule and Completion Time <br /> <br />A. If the Contractor desires to make changes in his method of operating which affect <br />the approved schedule, he shall notify the Engineer in writing stating that <br />changes are proposed and the reason for the change. If the Engineer approves <br />these changes, the Contractor shall revise and submit for approval, without <br />additional cost to the Owner all of the affected portion of the schedule. The <br />schedule shall be adjusted by the Contractor only after prior approval of his <br />proposed changes by the Engineer. <br /> <br />B. The contract completion time will be adjusted only for causes specified in this <br />contract. In the event the Contractor requests an extension of any contract <br />completion date, he shall furnish such justification and supporting evidence as <br />the Engineer may deem necessary for a determination as to whether the <br />Contractor is entitled to an extension of time under the provisions of this contract. <br />Engineer will, after receipt of such justification and supporting evidence make <br />findings of fact and will adviser the Contractor in writing thereof. If the Engineer <br />ILQGVWKDWWKH&RQWUDFWRULVHQWLWOHGWRSUR <br />determination as to the total number of days extension shall be based upon the <br />currently approved schedule and on all data relevant to the extension. Such data <br />shall be included in the next monthly updating of the schedule. The Contractor <br />acknowledges and agrees that actual delays in activities which, according to the <br />schedule, do not affect any contract completion date shown by the critical path in <br />the schedule do not have any effect on the contract completion date or dates, <br />and therefore, will not be the basis for a change. <br /> <br />30.9 Adjustment by Engineer <br /> <br />A. From time to time it may be necessary for the Contract schedule and/or <br />completion time to be adjusted by the Engineer due to the effects of job <br />conditions, acts or omissions of other contractors not directly associated with this <br />contract, weather, technical difficulties, strikes, unavoidable delays and other <br />enforceable conditions which may indicate schedule adjustments and/or <br />completion time extension. Under such conditions, the Engineer shall direct the <br />Contractor to reschedule the work to reflect the changed conditions, and the <br />Contractor shall revise his schedule accordingly. Schedule extensions affecting <br />the Contract completion time shall be granted only by the Engineer in writing.
