SPECIAL CONDITIONS <br /> <br /> <br />High Rock Waste & Recycling Center Improvements SC - 3 <br />Orange County, North Carolina JULY 2021 <br />DAA PN R00592-213N <br /> <br /> <br /> <br />S-10 - CONDUCT OF CONTRACTOR'S PERSONNEL <br /> <br />10.1 At no time during the course of construction shall any of the contractor's personnel behave <br />in any ungentlemanly or abusive manner on the job site or in any meetings or conference <br />involving the Owner or Engineer. Ungentlemanly, abusive, or uncooperative behavior shall <br />be grounds for dismissal or the contractor's personnel from the project. <br /> <br />10.2 No alcoholic beverages or narcotics of any description will be allowed on the job site at any <br />time. Furthermore, anyone under the influence of alcohol or narcotics shall be removed <br />from the job site immediately. A second offense involving contractor's personnel under the <br />influence of alcohol or narcotics on the job site shall constitute grounds for automatic, <br />permanent dismissal from any further work on the project. <br /> <br /> <br />S-11 - SPECIAL CAUTION <br /> <br />11.1 Extreme care shall be exercised when excavating with heavy equipment near existing <br />structures, pipelines and cable. The Owner will not assume nor accept any responsibility <br />for damages sustained by virtue of action on the part of the Contractor. <br /> <br /> <br />S-12 - SPECIAL NOTICES & SCHEDULING OF CERTAIN ITEMS OF WORK <br /> <br />12.1 At least 48 hours prior to interruption of electrical power, piping, or communications <br />systems notices shall be given to Owner and the Engineer. <br /> <br />S-13 - EXISTING UNDERGROUND PIPING, POWER CABLE, AND <br /> COMMUNICATION CABLE <br /> <br />13.1 Location of existing piping, power cable, and communication cable shown on the drawings <br />have been taken from public records and field investigations. However, locations and <br />completeness of underground piping and cable are not guaranteed and the Contractors <br />should not only make their own investigations but shall allow for contingencies which might <br />arise by reason of encountering unrecorded lines or of lines being in different locations than <br />shown on the plans. There is a possibility that the proposed construction may conflict with <br />existing utilities or drainage structures. Therefore, should such conflicts arise, the <br />Contractor shall take such actions as are necessary to protect the utility lines and structures <br />to prevent damage to save and to maintain service until such utility lines can be relocated <br />by the utility owner. Relocation of the utility will be the responsibility of the utility owner. <br /> <br />13.2 Extreme care shall be exercised when excavating with heavy equipment near existing utility <br />lines, drainage structure, railroad and streets. The Owner will not assume nor accept any <br />responsibility for charges assessed by private or public utility companies or from the N.C. <br />Department of Transportation for damages sustained to their property by virtue of action on <br />the part of the Contractor, nor for such charges as may be imposed by the utility or <br />Department of Transportation for personnel to furnish field location of the facility.
