Bid security of other Bidders whom OWNER believes do not have a reasonable <br />chance of receiving the award will be returned within seven days after the Bid <br />opening. <br /> <br />3.2 Contract Bond: A Performance Bond and Payment Bond are required. Each shall be <br />written on forms contained in the contract documents and shall be in the amount of 100% <br />of the contract amount. <br /> <br />S-4 - AVAILABILITY OF PROJECT SITE <br /> <br />4.1 The project will be available to the Contractor immediately upon issuance of "Notice to <br />Proceed". <br /> <br /> <br />S-5 - Omitted <br /> <br /> <br />S-6 - Omitted <br /> <br /> <br />S-7 - APPROVAL OF SUPERINTENDENT AND SUBCONTRACTORS <br /> <br />7.1 The Owner and Engineer shall have authority of approval of the project superintendent and <br />all subcontractors employed on the project. Within ten (10) days from receipt of the Notice <br />of Award, the name and written summary of qualifications of the project superintendent and <br />the name and address, and scope of work proposed for all subcontractors shall be <br />submitted for approval by the Owner and the Engineer. The decision for approval or <br />disapproval shall be final and binding. <br /> <br /> <br />S-8 - LIMIT OF SUBCONTRACTED WORK <br /> <br />8.1 Prime Contractors shall not sublet the contract, nor any portion thereof, without the written <br />consent of the Owner. <br /> <br />8.2 If such consent is given, the Contractor will be permitted to sublet a portion thereof, but <br />shall perform with his own organization work amount to not less than 50% percent of the <br />total contract amount. Upon request by the Owner, the Contractor shall furnish sufficient <br />documentation, satisfactory to the Owner, to demonstrate compliance herewith. <br /> <br />8.3 A subcontractor shall not sublet, sell, transfer, assign, or otherwise dispose of his contract <br />with the Contractor, nor any portion thereof, or of his right, title, or interest therein. <br /> <br /> <br />S-9 - PRE-CONSTRUCTION CONFERENCE <br /> <br />9.1 After award of the project, but before beginning work, a preconstruction conference shall be <br />held which shall be attended by the Engineer, Contractors, and Contractors' project <br />superintendents, and the Owner's representatives.
